James Lindgren, a aw professor at Northwestern University, began with numbers, citing a study in which ony 13.2 percent of facuty at the country s 100 argest aw schoos reported being Repubican or Repubican eaning. Of aw schoo facuty who have donated more than $200 to a poitica party, 81 percent have donated to Democrats (91 percent at HLS), according to the study. My opinion is that there is some discrimination in aw schoo hiring, Lindgren said. 2 BRIEFS New professors of practice wi share expertise on internationa aw and digita technoogy Shay testifies at Appe hearing Whiting, Gasser professors of practice ALEX WHITING and URS GASSER LL.M. 03 were recenty named professors of practice at Harvard Law Schoo. Whiting most recenty served as the prosecution coordinator in the Office of the Prosecutor at the Internationa Crimina Court, where he was responsibe for managing prosecutions of crimes against humanity, war crimes and genocide. He has focused on ICC investigations in Uganda, the Democratic Repubic of Congo, Sudan, the Centra African Repubic and Kenya, among other countries. He worked as the investigation coordinator at the ICC from 2010 to He previousy taught at HLS as an assistant cinica professor. Gasser, an executive director of the Berkman Center for Internet & Society, focuses his schoarship and teaching on information aw and poicy, societa issues, and the interpay between aw and innovation. His projects expore such topics as poicy and educationa chaenges for young Internet users, the reguation of digita technoogy (currenty with a focus on coud computing), information and communication technoogy interoperabiity, information quaity, the aw s impact on innovation and risk in the ICT space, cybersecurity, and aternative governance systems. Shave receives aw and economics meda The American Law and Economics Association seected Professor STEVEN SHAVELL as the 2014 recipient of the Ronad H. Coase Meda, a biennia award that recognizes major contributions to the fied of aw and economics. Shave is an expert on the economic anaysis of the basic subject areas of aw contracts, torts, property and crimina aw past director of the Law and Economics Program of the Nationa Bureau of Economic Research, and a co-founder and past president of the American Law and Economics Association. The award, named in honor of Ronad Coase, who won the Nobe Prize in Economic Sciences in 1991, was given to Judge RICHARD A. POSNER 62 in 2010 and Judge GUIDO CALABRESI in Manning eected to Academy of Arts & Sciences Professor JOHN F. Experts and judges convene on inteectua t property THE BIENNIAL HARVARD Law Schoo Conference on Inteectua Property Law attracted scores of IP awyers, businesspeope, academicians and judges to the schoo Apri 12 to discuss recent deveopments in IP aw. 4 Commencement 2013 The Harvard Law Schoo Cass of 2013 assembed at Homes Fied, in front of Langde Library, on May 29 and 30 to commemorate the competion of their studies. Professor BENJAMIN I. SACHS, a speciaist in abor and workpace aw, was this year s winner of the prestigious Abert M. Sacks-Pau A. Freund Award for Teaching Exceence, an honor bestowed each spring by the Harvard Law Schoo graduating cass. The award recognizes teaching abiity, attentiveness to student concerns and genera contributions to student ife at the aw schoo. In preparing his speech, Sachs tod the audience he had done what awyers are trained to do: He ooked to reevant precedent. But he tod the members of the Cass of 2013 that they are graduating into a word where the foowing of precedent wi not be enough. There are big-eague crises out there, and the peope who have come before you do not know how to sove them. It wi take creativity and invention, he said. And the best awyers ike artists and musicians are abe to integrate what has come before into the process of creating something new. In the end, Cass of 2013, the word is giving you a graduation gift, he said. That gift is a ong ist of probems to sove and no guide for soving them. It s a gift, he added, because, when it comes to your ives as awyers, the reay interesting stuff is going to begin exacty when the precedent runs out. When you don t know what to do. When you can t come up with an exampe of someone who has faced the decision you face, or who has made the move that you think needs to be made. Sachs joined the Harvard Law Schoo facuty in 2008 as an assistant professor. He received tenure ast year. Previousy, he was the Joseph Godstein Feow at Yae Law Schoo, where was awarded the 2007 Yae Law Schoo Teaching Award. From 2002 to 2006, he served as assistant genera counse of the Service Empoyees Internationa Union in Washington, D.C. His most recent schoarship incudes Unions, Corporations, and Poitica Opt-Out Rights after Citizens United (Coumbia Law Review, 2012) and Despite Preemption: Making Labor Law in Cities and States (Harvard Law Review, 2011). 5 A QUESTION OF BALANCE 5 from page 1 YOU WILL BE COUNSEL FOR SITUATIONS TO COME In her Commencement address, Dean MARTHA MINOW urged graduates to take inspiration from the ife and work of WILLIAM THADDEUS COLEMAN JR. 43, who was awarded the 2013 Harvard Meda, one of Harvard University s highest honors. Minow refected on the success Coeman achieved in his ife and career, despite a number of obstaces. Coeman, one of ony three African-Americans in his aw schoo cass, served on the Harvard Law Review and ranked first in his cass, athough his academic achievement wasn t recognized by the aw schoo unti decades ater. He was the first African-American to serve as a cerk for a U.S. Supreme Court justice. He co-wrote the ega brief for the appeants in the 1954 Brown v. Board of Education case and served as a member of Thurgood Marsha s ega team at the NAACP Lega Coeman Defense Fund, where he ater served as president. He went on to work on behaf of severa presidents, most notaby as secretary of transportation under President Ford. Minow described Coeman as someone who aimed to be a counseor, negotiator and probem-sover, whie maintaining the highest standards of ethics, serving the pubic interest and never taking a barrier as a reason not to try. Anthony Lukas Book Prize and was a New York Times best-seer. Students have described open hostiity to conservative views in cassrooms and condescending dismissas of decisions from [Supreme Court Justice Antonin] Scaia and other conservative justices, he said. HLS s Mark Tushnet spoke Encouraging inteectua diversity about the difficuties in hiring WATCH VIDEO bit.y/ conservative facuty, from both Inteectuadiversity-Pane3_2013 the suppy side and the demand side. On the suppy side, he described two probems: First, evangeicas are underrepresented because they have a genera skepticism about aw itsef, and second, conservatives ook more favoraby upon big firm practice. On the demand side, continued Tushnet, aw schoos are predominanty center-eft and do center-eft hiring. Tushnet contended that aw schoos in hiring mode have a greater wiingness to ook to the far right than the far eft, because those on the far eft are sooner viewed as unsound compared with those on the far right. Godsmith pointedy disagreed: There aren t any views eft of center that are disquaifying, he said, but there are views on the right that are. Joe Aicea 13, president of the Harvard Federaist Society, cosponsor of the event with the Mibank Tweed Student Conference Fund, eaborated on the issues raised in a conversation with the Harvard Gazette. What s ost is the opportunity for students to encounter the best arguments on a sides of a ega issue, articuated in the strongest form by those who actuay hod those beiefs, he said. Without inteectua diversity, students are not chaenged to think deepy about their own views, [so] they wi never have had the opportunity to reay test their own beiefs. 6 RICHARD LAZARUS Environmenta aw has faen in arrears ENVIRONMENTAL LAWLESSNESS WAS the topic of discussion on Apri 10, as Richard Lazarus 79, one of the nation s foremost experts on environmenta aw, gave a ecture marking his appointment to the Howard J. and Katherine W. Aibe Professorship of Law. Speaking before a crowd of famiy, students, coeagues and friends incuding Chief Justice of the United States John G. Roberts Jr. 79 Lazarus described how environmenta aw has faen in arrears. After a period of ega and poicy innovation that resuted in andmark statutes ike the Cean Water Act and the Endangered Species Act, Congress has not passed a major new environmenta statute or amendment since 1990, he said. The resut of this stagnation is a growing mismatch between contemporary technoogica and environmenta issues and outdated, infexibe statutes. One of the nation s foremost environmenta aw experts warns of ega stagnation Forty years after modern environmenta aw s remarkabe emergence here in the United States, there is a whoe ot of environmenta aw, but our nation s environmenta statutes nonetheess frequenty fai to address, in any systematic way, many of the most pressing environmenta probems we face. The aw and our governmenta institutions are again increasingy in arrears. The ega andscape is simutaneousy fu and empty, dominated by gaps, said Lazarus. Lazarus has represented the United States, state and oca governments, and environmenta groups in the U.S. Supreme Court in approximatey 40 cases, many of which raised natura resource and environmenta aw issues. From 2010 to 2011, he served as executive director of the Nationa Commission on the BP Deepwater Horizon Oi Spi and Offshore Driing, Professor Lazarus 79, with his wife, Jeannette Austin, and their good friend Chief Justice John G. Roberts Jr. 79 appointed by President Barack Obama 91 to investigate the root causes of the Guf of Mexico oi spi. His 2004 pubication, The Making of Environmenta Law (University of Chicago Press), is widey haied as the definitive history of the emergence and evoution of modern environmenta aw in the United States. The program of study wi guide students in navigating HLS s extensive course offerings and connect them with facuty whose interests they share. In February, Professors Brown-Nagin and Mack hed a kick-off event featuring a pane discussion with Chares Donahue, Annette Gordon-Reed and Mark Tushnet. Tomiko Brown-Nagin is an award-winning historian and constitutiona aw expert. Her 2011 book, Courage to Dissent: Atanta and the Long History of the Civi Rights Movement, won the Bancroft Prize in U.S. history, one of the highest honors awarded to a work in the fied of history. What does the Law and History program of study aim to do? The goa of the program is to make students aware that there are a number of word-cass ega historians on the facuty at Harvard Law Schoo who have a ot to offer to students who are interested in history casuay, but aso to students who might be considering a career in academia. We re aso buiding community. As of next year, we wi be incuding students in the ega history cooquium, which wi be a cass where students can meet professors who are coming to present their work. I think there s a fabuous opportunity for students to network with peope who are successfu in their professions. One of the things I want to be absoutey cear to students something that wasn t actuay crysta cear to me when I first started trying to combine my interest in socia history and aw is that the two are competey compatibe. It shoud not be considered odd or strange to study ega history in the context of aw schoo. If anything, I think studying the context in which the aw deveops makes it cearer how doctrine evoves over time, what goes into the making of doctrine, that it s not just the aw aone it s the identity of a awmaker, it is the socia context, it can be the identity of the paintiffs and defendants, it can be geopoitica considerations, it coud be what s happening in poitics. I want students to be comfortabe and interested and excited about studying ega history. How did the Law and History program originate, and how did your own experiences bring you to heping start it? It aunched in part because of a fet need on the parts of me and Ken [Mack] and the dean. We needed an institutiona space to showcase the facuty and to make connections among foks on campus who are interested in history. The program aso grew out of my own experiences and frustrations as a aw student interested in doing something that at the time was unconventiona: taking about aw and ega history not ony in a top-down manner, but from a bottom-up perspective. I didn t know how to do it within the confines of aw schoo. When you re doing something that s different or new, there s aways the response of, We, that isn t reay ega history; that s not constitutiona history. For students in the Law and History program, I want to be accessibe to them and I want to hep them not experience the barriers that I did when I was trying to make my way. The Pubic Service Venture Fund started taking shape about two years ago at a time when the economy was sti in decine. Whie many HLS students successfuy anded externa feowships such as those offered by the Skadden Foundation and Equa Justice Works, the increasing number of students seeking pubic interest work highighted a growing demand for more funding options, said Aexa Shabecoff, assistant dean for pubic service and director of the Bernard Koteen Office of Pubic Interest Advising, who is directing the fund. At the same time, the economic downturn ed to budget cuts in pubic interest organizations, as we as a significant rise in the need for ega services. The fund, administered by the aw schoo s Bernard Koteen Office of Pubic Interest Advising, comes with a host of reated services for appicants, especiay those appying for seed grants. Tefeyan received a Heyman Feowship for service in the federa government and has worked since 2009 in the Civi Rights Division of the United States Department of Justice, where he is currenty a tria attorney. During his time in the Civi Rights Division, Tefeyan has investigated and itigated cases of empoyment discrimination against immigrant workers. DAVID WERTIME 07 In December 2011, aong with two other HLS aumni, David Wertime co-founded Tea Leaf Nation, a news site that gauges Chinese citizen sentiment by anayzing the Chinese Internet. 8 GIVING BACK A century of earning and service One hundred years ago, a sma group of Harvard Law students formed an organization to provide ega aid to the poor. In the 10 decades since its founding, the Lega Aid Bureau the odest student-run ega services program in the country has heped thousands of cients. Many of its former members from the ate Supreme Court Justice Wiiam Brennan 31 to the current Governor of Massachusetts Deva Patrick 82 and the First Lady of the United States Michee Obama 88 have gone on to make important contributions to pubic service. On Nov. 8 to 10, the Bureau wi mark its centennia with a gaa ceebration at the aw schoo.
