3 Motion Carried FINANCIAL REPORT Linda Chang Reviewed/ Explained: Balance sheet. Previous year comparison of profit/loss sheet. Income/expense graphs. Recent/current arbitration legal fees still pending. Release time for CFO still outstanding(approximately one year) Reviewed graph comparison charts. Fair share fee payers consist of approximately 10.17% of membership. Member requested clarification of travel allowance. Travel allowance is modeled after CSU per-diem allowance. Extensive discussion on increase to travel allowance on lodging ensued. Consultant fees have decreased. Discussed criteria for hardship emergency fund. Motion #2 Motion was made by Joe Mendoza to accept financial report as presented. Motion Seconded: Gary Comer Discussion: General fund finances have improved from red ink to black ink. 4 Acknowledgement to John Howard for his diligence in the JATC. Acknowledgement to Ken Sanchez/Carl Kimberlin for their assistance in the Global Grievance/membership enrollment. Acknowledgement to Tracy Hanamoto/Gary Comer for their diligence in the Unfair Labor UCLA. Announced appointment of Carl Kimberlin as Statewide Steward by Business Mgr. Discussed/explained the responsibilities of appointment. Liaison to stewards only, does not oversee stewards. REPORT OF CONSULTANTS Fred Quiel gave summary of CSU Negotiations. Negotiations have been going on for nine (9) months. Negotiations lead to impasse on eight (8) articles. One (1) was settled in mediation. Seven (7) outstanding articles will probably not be settled until after global grievance. Liability on Global Grievance will financially impact negotiations. November elections will severely impact CSU budget. CSU Board of Trustees (BOT) will explore the use of furloughs/lay-offs/reductions in time/tuition increase etc. should the November tax increase not pass. Potential possibility that the BOT would impose a contract for SETC-United after fact finding. Tentatively agreed to language could be jeopardized Discussed the financial costs vs. the gains of the global grievance. Discussed/reviewed the seven (7) outstanding articles in the CSU negotiations. Lengthy discussion on contracting out. Discussed proposed good faith effort language to keep work in house in Article #4 Contracting Out. A minority of CSU campuses have a problem adhering to current contract language in Article #4 (Contracting Out) Discussed the impact to CSU membership should there be capitulation in some of the remaining articles. CFA has settled for a 0% salary increase. Discussed lack of in range progression funding in the CSU. Discussed re-instatement of step increases in the CSU. Discussed CSU funding of long term disability coverage. BUISNESS MANAGERS REPORT Page 4 of 8

5 Update on Global Grievance Discussed/summarized arbitration dates that have been held. Request for Information (RFI) for the global grievance had to be addressed to CSU legal counsel instead of individual campuses. SETC filed an Unfair Labor Practice (ULP) vs. CSU for not responding in a timely fashion to the Request for Information (RFI) on the global grievance. CSU has acquired new legal counsel. August 8 th and 9 th are next scheduled arbitration dates. Projected costs for global grievance are estimated to be $20k to $30k. Board of Trustees (BOT) is prepared to impose wage reductions. Extensive discussion on core issues of negotiations i.e. job security/wages/benefits. Jobs in the CSU are being lost thru attrition even though it is costing more to contract out the work. Additional discussion on how the global grievance will impact CSU membership. Discussion on the importance of having a contract in place before the November elections. The strength of current contract language was re-iterated. The importance of the need to settle a contract before the November elections was revisited. The Troops to Trades will help fund the JATC in the CSU. One year pilot program will be restricted to sixteen (16) apprentices in the Los Angeles area Campuses. Additional grant funds could be available. Calexico Community Action Council (CCAC) will handle administrative requirements. P.E.R.B. hearing was Glendale, Unfair Labor practice (ULP). U.C.S.D. Elevator Mechanics vs. SETC-United. S.P.B was settled for Facilities Worker II from C.S.U. Northridge. 3 months severance pay and expunged employee file of disciplinary actions. U.C. Irvine investigatory meeting pending. Suspected drug use by C.S.U. Northridge electrician discovered to be personal health issue. Pending C.S.U. San Diego (involving new stewards) was discussed by members. Discussion on (current and appointed) stewards training ensued. Stewards training for C.S.U. San Diego is pending and will be implemented as soon as possible. Page 5 of 8

6 C.S.U. San Francisco Facilities Worker II has entered the J.A.T.C. as a Locksmith. U.C. Irvine has held a Labor Management Meeting as per their M.OU. Membership Meetings were C.S.U. San Jose and C.S.U. Long Beach. Update on U.C. San Diego negotiations. Discussed the importance of registering for the member s only section of S.E.T.C.- United website. REPORT OF OFFICERS U.C. Los Angeles has been docking pay from stewards that attend Grievance meetings. Recent P.E.R.B settlement will probably alleviate the issue. Discussed pending U.L.P s for U.C. Los Angeles. Update on demotion of Electrician to Facilities Worker for lack of certification test. Twenty eight (28) Grievance U.C. Los Angeles. Twelve (12) were unilaterally dismissed by U.C. Los Angeles. (Pending U.L.P.) Inconsistence in implementation of U.C. Los Angeles. P.E.R.B. hearing on Reduction in Time (RIT) pending for U.C. Los Angeles. Discipline should be consistently administered unit wide per M.O.U. U.C. San Diego have become difficult and will more than likely end up in impasse/mediation. Discussed pending Minh Phan pending arbitration. (Illegal search) P.E.R.B. hearing held Glendale, (U.C. San Diego Elevator Mechanics vs. S.E.T.C.-United.) decision pending. REPORT OF DELEGATES U.C. Merced is working with Department of Apprenticeship Standards (DAS) liaisons, and L.E.A to U.C. Merced. Dave Rogers (U.C. San Diego) University of California Office of the President (UCOP) Union Coalition meeting report. U.C.O.P. will be sending out an employee climate survey or quality of U.C. U.C.O.P. is interested in the Campus level. Centralized U.C. Payroll will be implemented (Bi-Monthly) for cost savings. Member dependent audit is still in progress. September deadline for appeal has been set No response could end up in de-enrollment of member dependents until open enrollment. Page 6 of 8

7 Increase in cost to Medical Benefits a possibility in the future. Discussion on future 2 Tier Retirement for University of California Retirement Pension. (U.C.R.P.) George Redden (C.S.U. Long Beach.) Board of Trustees Meeting (BOT) report. There is a current one hundred and forty million dollar ($140m) deficit in the California State University budget (CSU). The possible need to raise tuition if the tax initiative does not pass in the November ballot. California legislature has proposed additional funds to C.S.U. if they do not raise student tuition. Possible pay cuts in the future for C.S.U. employees statewide. Eligible S.E.T.C. membership will probably be early retirement vs. pay cut. George gave thanks to E-Board members/ Delegates that have provided their C.S.U. Long Beach. REPORT OF STEWARDS C.S.U. San Diego Cal Mason report. Numerous Job order Contracts (JOC) are going San Diego. Some of the contracts are up to two (2) years in duration. Cal spoke on how they are involved in the JOC process. The good faith effort to notify S.E.T.C-United is not being followed. The possible need to file a Grievance before time lines expire is being explored. San Diego hired a full time employee (FTE) Power plant operator. There is no current safety San Diego. C.S.U. Fullerton Ken Sanchez report. Thanked all for the opportunity to assist with the global grievance/negotiations. Discussed current grievances in progress. Two (2) Electricians, Two (2) Facilities Workers, and One (1) Building Service Engineer have been hired full time (FTE). Lead positions have been promoted to Supervisor. C.S.U. Fullerton is looking to hire more personnel in the near future. Ken is working on attempting to have currently laid off S.E.T.C-United members fill vacant/open positions. Future Union Coalition meetings on C.S.U. Fullerton Campus are in early stages of implementation. OLD BUISNESS Page 7 of 8

8 Update on Asbestos California O.S.H.A charge U.C. Los Angeles (decision is pending, with possible fines). Cal. O.S.H.A. want s a well prepared case. Member inquired were we are with the committee established to amend the constitution and by-laws of S.E.T.C-United. Herb spoke on how the committee has been established; (although on hold for the moment) any changes to the constitution and by-laws of S.E.T.C.-United would go to a membership vote for ratification. Discussion on future elections ensued. A contracted third party service would handle the voting process. NEW BUISNESS GOOD OF THE UNION Member spoke on the true meaning of being a Union member The importance of solidarity was discussed. C.S.U. San Luis Obispo is hiring temporary electricians. Special thanks to C.S.U. San Diego for hosting General Membership meeting. Notice was made to members for a job well done in the retrofitting of Peterson gym # 153 (Job done in house).
