3 Captain's Corner Groot The first day of summer is technically June 21. While this may be true in some parts of the country, those of us living in Houston knew it was here by Mother s Day. The temperature climbed to 86 o and Hollywood was already raking in the profits from its first summer blockbuster: Guardians of the Galaxy Vol. 2. Whatever your movie preferences, I think we might all agree that one of the most surprising elements of the successful Guardian films is the popularity of the character Groot. I am not learned in the lore of the Guardians universe and the treelike Groot, nor do I plan to become so. I simply know that his dialogue Photo Courtesy of Disney Motion Picture Studios. in the films is essentially limited to three words: I am Groot. Generally speaking, it is not a role that seems like it would catapult anyone to fame and fortune. And yet, through the power of expression, the character works and audiences love him. With this simple, three-word sentence, Groot can communicate anything. This made me wonder: were there three words I could use to communicate diverse messages about our maritime community? Yes. Follow the cargo. Follow the cargo as it enters Houston to see that our imports provide supplies for a growing population and for industrial construction. Recent announcements for major distribution centers will increase storage and distribution of goods for this major metropolitan area and possibly further into the hinterland. Steel imports appear to be in the early stages of recovery as domestic oil production becomes attractive again. Oil imports are climbing as domestic producers can export domestic oil at a premium and use foreign oil for refining. Speaking of exports, follow the cargo, and you see that refined products have a ready outlet for exports through the port. LPGs and ethane from Houston and LNG from Sabine Pass are pushing export numbers upward. Multiple LNG projects, representing billions of dollars in investment, are underway CAPT Bill Diehl, USCG (Ret.), P.E. in the ports of Freeport and Corpus Christi. Port Houston has undertaken massive investment in its container terminals to be able to keep up with demand to export plastic resins via container. Houston is the top port in the U.S. for exports, and there is no sign of relinquishing that title. Follow the cargo and you ll find that cargo doesn t just flow in and out of the port of Houston it swirls about through the shore side companies, as well. Refineries, plastics manufacturers, and packing companies are among the companies providing valueadded services within reach of port access. With access to a growing labor pool, functional transportation infrastructure, and accessible natural resources, Houston can remain a globally-competitive manufacturing center. Whether the economy is booming or bombing, just follow the cargo to see that Houston is positioned to be a leader in maritime commerce. Working with our industry partners to keep it that way is a big part of our mission at the Port Bureau. While we may not be saving the galaxy, I m sure Baby Groot would dance to that. April was nearly as busy as March for Texas ports with a slight dip of less than one half of one percent. That slight arrival drag was not enough to pull the arrival count for the first four months of the year below that same timeframe for Granted, the bulk of the gains were attributable to the trio of tripledigit ports which all posted modest increases for the month and remain modestly ahead of last year s arrival pace. One wonders, in light of that, why the overall numbers were down if the three busiest ports posted gains? The answer lies in the fact that all but one of the remaining five ports were in the red. Freeport experienced the biggest monthly tumble with a 25% plunge. Yet, this change was more optics than anything since the previous month was a record breaker. That is borne out by the fact that Freeport continues to maintain the largest percentage gain over its sister ports on a year-to-date basis. Brownsville, on the other hand, June 2017 saw its lowest monthly arrival number in nearly 2 years; registering a 10% monthly decline. To date, the port is over 17% below last year s cumulative arrival numbers. Half way across the state, Galveston also continues to struggle. The port has not recorded a monthly positive change since last September. Its most recent monthly loss was 3%. Worse yet, after 2016 s 13% setback, 2017 is currently running 6% below that. It too, saw one of its lowest arrival numbers since mid-2015 with its 3rd consecutive monthly decline. Not surprisingly, the latest fall of 5.6% pulled its year to date percentage down to over 4% vis-à-vis On a positive note, the port continues to export prodigious amounts of distillates for the European and South American market. The smallest of the triple-digit trio Corpus Christi had a respectable Corpus Christi, 5.8% Freeport, 16.5% Houston, 2.3% Grand Total, 0.8%

Its monthly arrival count has not varied by more than 4% since the beginning of the year. Those consistent numbers have yielded a year-to-date climb of 6% following its most recent monthly rise of nearly 2%. The port s recent expansion on the petrochemical front has played a significant role in its current run of positive numbers. Sabine, on the other hand, still lags behind its 2016 pace which, was more than 7% off of 2015 s arrival throughput. Thus, despite a 1% uptick in the monthly arrival numbers, Sabine is trailing 2016, year-to-date wise, by 4%. Sabine s biggest adjustment has been the flow of crude into its infrastructure via pipeline rather than Suez Max tankers. On a positive note, LNG exports are steadily gaining ground and the export of distillates is partially offsetting the slight fall in imports. The nation s largest export port, Houston, fared better than both Sabine and Corpus Christi with 2% more vessel arrivals over the past month. Tankers, in particular, enjoyed a robust arrival count that was 9% higher than the previous month. Unfortunately, this category is well off last year s pace 9% to be more precise. Chemical tankers did nearly as well as their tanker brethren as reflected in a 8% surge. The biggest difference between the two categories is that chemical tankers are up 19% for the year. This appears to be the trend going forward well into the future given the expansion of chemical export facilities along the Houston Ship Channel. LPG is also running ahead of its 2016 numbers. The 9% year-todate gain is even more impressive when one considers that there was not any monthly gain for this category of vessel. Another bright spot for the month was highlighted by the 9% monthly climb for general cargo vessels. That is where the shine ended since 2017 s numbers are 20% bleaker than 2016 s. Worse yet, 2016 ended 16% below 2015 s general cargo arrival count. Bulk vessels got hammered in April as 23% fewer arrivals transited the Houston Ship Channel; however, the arrivals for the first four months of 2017 exceed 2016 by 16%. On the container front, imports fared much better than exports; by nearly a third since the beginning of the year. While the same number of container vessels called upon the Port s container terminals in both April and March, 9% fewer containers crossed those docks in the same timeframe. To date, 2% more vessels have delivered or loaded 12% more containers. The same can be said for the car carriers since both the vessel count and total vehicles moved are flat to slightly positive. It appears that the demand for new cars may be tightening as lenders are more parsimonious in the car loan arena. Ro/Ro activity at Port Houston s City Docks was on a tear for the first three months of the year but April s single Ro/Ro vessel arrival was more indicative of last year s lull. Oceangoing tows were also off by 4% for the month. Yet, 2017 s torrid pace remains intact given that 62% more of these barges have called upon the Port compared to last year. The inland towing sector was similarly situated with 10% fewer transits through the region during the last month. This category is still 9% ahead of last year. Indeed, the big three ports, held their own over the last month despite the large number of monthly percentage drops at the smaller ports. Clearly, the petrochemical export machine is being buoyed by overseas demand for cheap manufacturing commodities which, in turn, accommodates a growing population s penchant for consumables. Indeed, the ever-thickening traffic that congests new and expanded roadways leading to and from more and more subdivisions undergirds much of that demand for imports. Fortunately, the region dominated by the larger population centers - has plenty of exports to pay for all of that stuff. ò June

He has served as President and CEO since April Prior to that, he served as President and Chief Operating Officer since January 2014 and Chief Financial Officer since March He served as Chairman of Kirby Offshore Marine from February 2012 to April 2013 and served as Executive Vice President from March 2010 to January 2014, having joined the Company in February Prior to joining the Company, he served in operating and administrative positions beginning in 1988 with FMC Technologies Inc. 7 port bureau updates Savage Completes Purchase of Settoon Towing s Liquid Bulk Assets Savage Inland Marine, LLC, a subsidiary of Savage Companies, completed purchase in April of the Liquid Bulk division assets of Settoon Towing LLC which includes 35 towboats and 63 liquid tank barges with a total capacity of nearly 2 million barrels. The acquisition provides Savage with a scalable platform for building its marine business going forward. With the addition of these vessels, Savage s marine capabilities include the transport of a variety of liquid products on the Intracoastal and inland waterways, as well as barge fleeting, towing and dock services on the U.S. Gulf Coast. Mike Ellis, Settoon Towing s former president, had previously joined Savage to lead its Marine Solutions Group, and more than 230 former Settoon employees have become Savage Team Members. Operations management will continue to be based out of a newly built, state-of-the-art operations and training center in Gibson, LA, and at offices in Baton Rouge, LA and Bridge City, TX. Acquiring these strategic assets significantly accelerates our growth in the marine market and adds breadth and depth to the supply chain solutions we offer, said Kirk Aubry, Savage President and Chief Executive Officer. Corps Visit Highlights Houston Ship Channel s Importance to Nation Port Houston Commission Chairman Janiece Longoria shared highlights of a briefing and tour of the Houston Ship Channel provided to Lt. General Todd Semonite, Commanding General and Chief of Engineers for the U.S. Army Corps of Engineers during the Mary 24 meeting of the Port Commission. During his visit, Chairman Longoria outlined the economic impact of the Port of Houston and made the case that dredging the Houston Ship Channel is an investment that generates jobs and economic benefit for the nation. Lt. General Semonite came to Houston to see first-hand all the activity at the Port of Houston, and review the progress of improvements being considered during the current Corps mega-study. Conducted in partnership with Port Houston, the study is looking at potential future improvements to the channel. Following a briefing with leadership and staff, Lt. General Semonite was given a waterside channel tour, highlighting opportunities of the project. Chairman Longoria shared that Lt. General Semonite was very impressed with what he saw and learned. Poe, Wittman, Green and Lowenthal Introduce Domestic Maritime Centers of Excellence Act Representatives Ted Poe (R-TX), Rob Wittman (R-VA), Gene Green (D-TX) and Allen Lowenthal (D- CA) introduced legislation (H.R. 2286) on May 3, 2017, intended to advance the capabilities of two-year community and technical colleges to assist the federal government and industry in securing the talent pipeline for domestic maritime industry jobs. There are over 56,000 direct maritime related jobs at the Port of Houston alone, said Rep. Ted Poe. As the workforce grows, students must be ready to enter the maritime industry with job ready skills. This legislation simply gives local community and technical colleges the resources to effectively prepare their students. As Co- Chairman of the PORTS Caucus, I recognize that this legislation takes an important step forward in ensuring future workforce growth for the Port of Houston and ports across the nation. In our district we have a surplus of maritime jobs and not enough people with the skills and training to fill them, said Rep. Green. The industry is continuing to invest and grow along the Port of Houston, and we want to make sure that our constituents have the opportunity to take these high skilled jobs. This bipartisan legislation will help bridge the gap. It s good for our local community, it s good for our businesses, and it s good for the American economy. Locally, San Jacinto College applauded the introduction of H.R We thank Rep. Green, Rep. Olson, Rep. Poe and others for championing this legislation on behalf of San Jacinto College and our maritime partners, said Dr. Brenda Hellyer, San Jacinto College Chancellor, in the school s press release. Our region is home to one of the world s largest ports and is ranked second in the nation for maritime jobs. This designation will allow us to continue to provide U.S. Coast Guard-approved training to help meet the workforce needs of the Gulf Coast Region. Seabrook Logistics Receives First Vessel Seabrook Logistics LLC, owned 50/50 by subsidiaries of LBC Tank Terminals, LLC and Magellan Midstream Partners, L.P., announced receipt on May 3, 2017, of their first AFRAMAX tanker and commissioning of Phase I of its crude oil and condensate marine terminal and pipeline infrastructure. The Phase I project consists of more than 700,000 barrels (111,000 cubic meters) of new crude oil and condensate storage, new AFRAMAX ship dock with 45 foot draft and a new 18 inch Photo courtesy of LBC Tankers. (46 centimeter) diameter pipeline, connected to an existing third-party pipeline to transport crude oil to a Houston area refinery. The next phase of the expansion project to add 1.7 million barrels (270,000 cubic meters) of additional storage and construct a new 24 inch (61 centimeter) pipeline connected to Magellan s Houston crude oil distribution system at Genoa Junction is currently under construction and anticipated to be in-service by mid June 2017

10 Legislature Texas Legislature Passes New Laws Affecting the Port Region Kyle Beam, GHPB The 85th Regular Session of the Texas Legislature has come to an end after another controversial session. Many controversial bills were debated and protested, but new legislation was enacted, including several new laws that directly affect the maritime and transportation industries. The bill that looks to have the most impact is SB The specifics of the bill have been debated in various forms over the years between members of congress and industry, but a consensus was finally reached this year. The bill establishes what many in the Houston area call the heavy haul corridor. More specifically, the Legislative Budget Board Fiscal Note states The bill would amend the Transportation Code, to authorize the Texas Department of Motor Vehicles (TxDMV) to issue an annual permit authorizing the movement of sealed intermodal shipping containers as defined by the bill. The bill would establish certain restrictions regarding axle weight and configurations and other conditions for vehicles that may operate under this permit. An applicant for a permit would be required to designate each counties and municipality in which the permit would be used. The bill would require an applicant to pay a permit fee of $6,000, of which 50 percent would be deposited to the State Highway Fund (SHF), 30 percent would be divided equally among and distributed to the counties designated in the permit application, 16 percent would be divided equally among and distributed to the municipalities designated in the permit application; and four percent would be deposited to the credit of the TxDMV Fund. The bill would require the fee for a permit application received on or after January 1, 2028, to be determined by TxDMV after consultation with the University of Texas Center for Transportation Research and the Texas A&M Transportation Institute. The bill would require the Comptroller to send amounts due to the counties at least once each fiscal year for deposit to the credit of the county road and bridge fund. The bill would require the Department of Public Safety (DPS) to adopt rules requiring additional safety and driver training for permits issued under the provisions of the bill. The bill would create a Class C misdemeanor for certain offenses related to the permit. The bill would require the Texas Department of Transportation (TxDOT), in each even-numbered year beginning in 2022, to conduct and publish the results of a study on vehicles operating under a permit issued under the provisions of the bill. The bill currently only authorizes the use of the heavy haul corridor for trucks carrying ocean-going containers moving through international waters. Along with the international requirements the safety requirements for the trucks are being overhauled. There 10 June 2017

11 legislature are two classifications of trucks and cargo where a permit will be issued. The first is a container must be moved on a truck-tractor and semitrailer combination that has six total axels and is equipped with a roll stability support safety system and blind spot systems, and the weight is not to exceed 93,000 pounds. The second is a container must be moved on a truck-tractor and semitrailer combination that has seven total axels and is equipped with a roll stability support safety system and blind spot systems, and the weight is not to exceed 100,000 pounds. The current version of the law comes with route restrictions for the permit-issued trucks. The trucks will not be allowed on the interstate highway system or load-restricted roads and must operate only on the roads and highways approved by the Texas Department of Transportation. The bill states, the route must also begin or end at a port authority or port of entry that is located in a county contiguous to the Gulf of Mexico or a bay or inlet opening into the gulf; and may not exceed 30 miles from the port authority or port of entry. Along with SB 1524, the state also passed SB 28 creating the Ship Channel Improvement Revolving Fund. The law becomes effective immediately and creates the Ship Channel Improvement Revolving Fund. The fund will be administered by the Texas Transportation Commission, which establishes a revolving loan program to use money from the fund to finance qualified projects for navigation districts. The bill defines qualified projects must deepen or widen a ship channel, be authorized by the United States Congress, and meet any other standards provided by commission rule. The bill adds an amendment to the existing transportation code that allows the Commission to use money from the Texas Mobility Fund for port access improvement projects. The bill defines port access improvement projects as the construction or improvement of public roadways that will enhance connectivity to ports. The bill also creates a committee of nine members: seven members appointed by the Commission one representative of the Port of Houston Authority, three representatives of the maritime ports of the Upper Texas Coast and three representatives of the maritime ports of the Lower Texas Coast one member appointed by the lieutenant governor and one member appointed by the speaker of the house of representatives. 14 spotlight Spotlight on Kirby Corporation Kyle Beam, GHPB City streets around the world are paved with the names of heroes and legends known internationally, nationally and locally. Houston is no exception to that rule. The city itself named after Texas greatest hero, Sam Houston, and its streets are filled with the names such as Milam, Dowling, Cullen and Fannin. These names represent heroes of the Texas Revolution and other wellknown figures throughout Texas history. Along Kirby Drive, the name of another impactful Houstonian, John Henry Kirby, is seen by all Houstonians, although many today have no idea the extent to which he helped develop the city. John Henry Kirby s legacy is cemented and continues to grow in the halls of the Kirby Corporation. Kirby, the Man John Henry Kirby was born on a rural East Texas farm during the beginnings of the Civil War, on November 16, Kirby spent most of his formative years around the farm in Tyler County where he received limited formal education. Learning to read and write from his mother, going through intermittent sessions in Tyler County s rural schools and less than one semester at Southwestern University in Georgetown, the journey that followed Kirby is nothing short of remarkable. After leaving Southwestern, Kirby, with the influence of friend and state senator, Samuel Bronson Cooper, received an appointment as a calendar clerk of the Texas Senate in Kirby left the senate in 1884 to begin his law career. He was admitted to the bar in the fall of 1885, and soon after began to use his skills to amass a small fortune. 16 spotlight Kirby partnered with a group of investors from Boston, who came to Kirby for his legal services after a recommendation from Cooper, to speculate the East Texas timberlands. In the timberlands of East Texas, Kirby became a legend. Nicknamed the Prince of the Pines, at his peak Kirby controlled more than 300,000 acres of East Texas pinelands and operated 13 sawmills. Timber was not the only interest for Kirby. With the discovery of oil at Spindletop, Kirby wanted to try his hand at a new venture. Despite early failures with oil, Kirby persisted and, in 1921, formed the Kirby Petroleum Company. The company was initially an independent oil and gas exploration and development company. The Name Lives On As the years went on Kirby Petroleum expanded their business interests and groups. In 1969, Kirby Petroleum entered the marine transportation business with the acquisition of Dixie Carriers, Inc. The oil and gas boom of the early 1980s was a very active period for Kirby s oil and gas operatives with extensive exploratory drilling in the Fletcher Field of Oklahoma. The field was not as productive as anticipated and the oil and gas operation sustained significant operating losses. The cash flow of Dixie Carriers and the stock value of both Dixie Carriers and Universal Insurance Company, a Puerto Rico property and casualty insurance company owned by Kirby, were used to financially support the oil and gas operation. After years of losses by the oil and gas operations, the marine transportation, as well as the diesel engine services businesses quickly became the core drivers of the company, and in 1987, the Kirby board of directors adopted a strategy to focus solely on them. Pursuant to the strategy, the oil and gas assets of the company were sold off in 1988, and the company was renamed, as it stands today, in 1990, as Kirby Corporation. Kirby Corporation exists today as the nation s largest domestic tank barge operator transporting bulk liquid products. With over 4,000 employees, it has expanded greatly from when John Henry Kirby first founded the company. Today, Kirby s inland fleet represents 16 June 2017

17 spotlight approximately 23 percent of the U.S. inland tank barge capacity. Its inland fleet is made up of 876 tank barges with 17.9 million barrels of capacity and 230 towboats, serving the nation s coasts via the Intracoastal Waterway and the Mississippi River system. In addition to the inland fleet, Kirby also has a coastal fleet of 69 tank barges with an estimated 6.2 MM barrel capacity. This fleet services all three U.S. coasts, as well as, Hawaii and Alaska. Along with the marine transportation business, Kirby s diesel engine services business has greatly expanded. This business services diesel powered engines for everything from hydraulic fracturing equipment, to marine equipment, to peak and base load power generators. What has made Kirby so successful over its lifetime? Matt Woodruff, director of public and government affairs, credits the employees throughout the company and the structure of the company. There is a great collaborative environment from everyone in the company, Woodruff said. We have an alignment from the very top with the CEO down to the guys on the decks of our vessels with the core company values, he added. Learning the Kirby way begins immediately for new employees in the company, especially for the boat crews. We invest heavily in training our boat crews, Woodruff said. He added, we prefer hiring people who have never been in the industry before in order to train them on our policies and procedures. Woodruff said Kirby likes to hire veterans because of their experience transfers well to the maritime business. Woodruff added he is most proud of Kirby for its commitment to veterans. Looking to the Future Safety is a cornerstone principle at Kirby. The commitment to safety can be seen throughout the entire company, from the boat crews all the way to the CEO. Recently, Kirby instituted a policy to go even further in ensuring the safety of their employees: Stop Work Responsibility. This new policy gives any employee, no matter their level, the responsibility to stop a work situation they deem is unsafe. It s not just the right, but the duty for the employee to stop an unsafe work environment, Woodruff said. The company is quick to praise the employees who use this initiative and even honors them annually at a dinner. Woodruff said the barge fleet is the youngest it has ever been because of the level of barge replacements over the past few years. Along with investment in the fleet, Kirby is always looking for better ways to serve their customer s needs, We want to have the right equipment in the right place when it is needed, Woodruff said. Kirby accomplishes this in part by being a leading company in acquisitions in the industry, but as Woodruff pointed out, Kirby is always looking for opportunities to grow but acquisitions must meet our financial criteria for investment. Along with growing the company, Kirby is leading the way in the innovating the industry with new technology. Internally, they have launched a new app for their employees to utilize that should improve safety and efficiency company wide. The new app, called Kirby Connect, allows employees to use their smartphone to report near misses, see their travel schedule, and look up company procedures and vessel schedules. The app was created because it was the right thing for us to do, Woodruff explained. Kirby Corporation looks to continue to do the right thing for them, their employees and their customers for many years to come. Chovanec, Senior Vice President-Fundamentals, Enterprise Products Partners L.P., was the featured speaker at the Port Bureau s Commerce Club luncheon at Brady s Landing on May 11, Chovanec included a slide presentation with his remarks entitled, Preparing To Export Virtually Everything We Touch. Chovanec started his presentation with a brief overview of market fundamentals for liquid hydrocarbons and natural gas. Emerging markets, particularly in Asia, are projected to dominate liquid hydrocarbon demand growth through 2040, with demand growth in those markets exceeding the decline in demand from developed nations. At the same time, U.S. gas to crude ratios from unconventional production, namely shale, are globally competitive and enable petrochemical manufacturing. Using these points as a springboard, Chovanec shared Enterprise activities in the Houston area with attendees, stating, We are heavily invested in the Houston Ship Channel It s very strategic, very important to us. He emphasized operations at the best in class Houston Ship Channel Terminal, the world s largest ethane export terminal at Morgan s Point, and their Mont Belvieu plant complex. Mont Belvieu is connected to markets by a spaghetti bowl of pipelines, said Chovanec, adding later in his talk that Enterprise is connected to every ethane terminal in the U.S. Enterprise s natural gas flow patterns historically flowed from south to north. Now, with so much production, said Chovanec showing a map of their natural gas forecasted flow patterns through 2022, we had to take the grid and turn it on its head! It is projected that new capacity will be needed to satisfy future natural gas demand in South Texas. Concluding his presentation, Chovanec stressed the importance of their terminal facilities at the Houston Ship Channel, Beaumont, Seaway Freeport, and Seaway Texas City. Enterprises integrated network of midstream energy assets is well positioned to benefit from the expected growth in both the production and demand for crude oil. The Q&A session focused primarily on LNG production, competition, and market opportunities. Chovanec particularly noted that while shale reserves are available around the world, other nations lack the ready infrastructure of U.S. No other countries have what we have, he concluded.
