1 Is Long Island s Billion for Infrastructure now a Jump Ball? It looks like State Senate Majority Leader Dean Skelos and Governor Andrew Cuomo are going to war over whether the bi-county area will receive as much as $1 billion for strategic infrastructure projects after the Governor s State of the State address marginalized Long Island, a region of 2.7 million people. As noted by Long Island Business News (LIBN) reporter Jacqueline Birzon, Long Island was not a top priority in Gov. Andrew Cuomo s allocation of a $5 billion legislative surplus, and many consider that a huge understatement. Prior to the January 21st budget release, LICA, along with many other Long Island political and business leaders, were hoping to receive word that as much as $1 billion would be dedicated toward much needed infrastructure improvements in our region. However, the Governor s proposed budget for allocated only $150 million in additional infrastructure investment a mere 3% of the surplus funds and that was earmarked to construct vertical parking structures at strategic locations on Long Island and not to other infrastructure projects that many deemed more important. Long Island Contractors Association (LICA) Executive Director Marc Herbst questioned the motivations behind the budget proposal. Governor Cuomo is either making a tactical maneuver in his budget negotiations with the Long Island Republican Senate majority delegation leaders to force their hand to give up some of their other priorities, or he has written off our region. I believe the Governor has simply made his first chess move and I remain optimistic that the final approved budget will address our regional infrastructure needs. 2 2 Skelos s line in the sand is about infrastructure Majority Leader Skelos (R-Rockville Centre) has already told LICA and the Association for a Better Long Island (ABLI) that he intends to direct $1 billion to Long Island, saying, It should go to sewers and infrastructure projects that just don t prep efficiencies but pave the way for increased private investment. And Senator John Flanagan (R-East Northport) said that the surplus should be used toward long-term infrastructure investments. Business leaders agreed. Long Island Association (LIA) President Kevin Law issued a statement that said, we deserve more, and added, We want more and we are going to work with the Long Island Senate delegation to fight for more. Adding to the uncertainty of the outcome is the turmoil in the Assembly chamber following the historic resignation of longtime Speaker Sheldon Silver. It is expected that his replacement will share his New York City-centric political view, making the debate over dollar allocations that much more contentious. Denise Richardson, Executive Director of the General Contractors Association of New York (GCA NY) recently testified at the joint legislative budget committee hearing on transportation, stating, Without a well-maintained and reliable road, bridge, rail, subway and bus network, the state s economy cannot grow. The poor condition of our transportation infrastructure increases congestion, travel time, accident rates and vehicle operating costs. She noted Historically, New York s transportation network has benefited from federal funding, but said, It is well known that the federal gas tax is no longer sufficient to fund the nation s transportation needs, but there is no consensus in Congress on a future bill, and We cannot cede our economic future to the whims of Congress. Among other requests for the MTA, Ms. Richardson is calling on government to: - Fund and approve a five year capital program for both the MTA and DOT that is sufficient to address the critical infrastructure needs in New York, noting that the current state-proposed $150 million a year for 5 years is insufficient. - Increase revenues dedicated to transportation infrastructure investments. The Highway Trust Fund: Fix It or We All Fail While infrastructure advocates are still feeling the sting from Governor Cuomo s proposed New York budget, there s even greater concern brewing over the nation s Highway Trust Fund and the temporary funding bill which is set to expire at the end of May, In responding to President Obama s State of the Union speech, The American Road & Transportation Builders Association (ARTBA) President Pete Ruane observed, If the new Congress is serious about proving to the American people it can govern and if the President wants to accomplish something that has been on his agenda for years, then new investments in surface transportation are an area ripe for bipartisan consensus and action. 3 3 However, policy legacies won t be earned with more short-term gimmicks and temporary patches of the Highway Trust Fund. It will require Congress and the President to enact a long-term revenue stream to ensure state governments have the reliable federal partner they need to make overdue improvements to America s roads, bridges and transit systems, Ruane continued. While political leaders from both parties recognize the critical importance of passing a long-term bill, the collective voice of our industry must continue to be heard in Congressional districts across the country in order to create and sustain the momentum for action on Capitol Hill. House Transportation Committee Chairman Bill Shuster (R-Pa) has said, I believe that it is imperative that we repair our crumbling infrastructure through fiscally responsible legislation, while Senator Barbara Boxer (D-Calif) said, We have to have the courage, in the Senate and in the House, to fund a multi-year bill. Transportation Secretary Anthony Foxx said, The transportation system doesn t care about the political challenges or the funding challenges of addressing its need. From its perspective, and from mine, we are either meeting its needs or we re not. He added, In order for the system to be as good as the American people, we must do something dramatic to hell with the politics. Amen. 4 4 Representative Lee Zeldin Named to Three Subcommittees Long Island Congressman Lee Zeldin (R-1 st C.D.), who recently joined the House Transportation & Infrastructure Committee, has also been selected to serve on three subcommittees that will deal with issues ranging from civilian operated drones to millions of gallons of crude oil rumbling through towns and cities on rail cars. As Vice Chairman of the Subcommittee on Aviation, he will have jurisdiction over all aspects of civil aviation such as safety, infrastructure, labor, commerce and international issues, including agencies such as the Federal Aviation Administration (FAA). In addition, the Congressman will sit on the Subcommittee on Railroad, Pipelines and Hazardous Materials and the Subcommittee on Coast Guard and Maritime Transportation. The lawmaker noted that As a representative and advocate for my constituents on Long Island, serving on the Transportation & Infrastructure Committee will provide me an added ability to deliver victories for my district. He also stated that The subcommittees I was appointed to have jurisdiction over many federal agencies that play a direct role in the issues we face here on Long Island. Long Island Business Leaders Bring Together Public Officials in Albany It was a long way to travel to put multiple Long Island bold face names in one room, but the annual State of the State address in Albany holds that kind of attraction. LICA Executive Marc Herbst says the shared interest of strengthening Long Island brings together leaders in banking, labor, technology, education, energy and commerce in an Albany setting that while frigid, is productive. On Long Island we are so busy pursuing our individual agendas, it would be difficult to put all these leaders in one room. The State of the State compels you to stop and shift your focus to this important policy speech. That includes co-sponsoring receptions with our colleagues at Bethpage Federal Credit Union (BFCU). 5 5 P3s Fast Tracked in PA While NYS Still Stuck in Neutral New Yorkers walk fast, talk fast and usually act fast. We are accustomed to being the first, the fastest and the biggest. So LICA Executive Director Marc Herbst wonders why other states, such as Pennsylvania, are awarding huge public-private partnerships (P3s) for infrastructure improvements as evidenced by the Pennsylvania Rapid Bridge Replacement Project, which recently achieved commercial close by the PennDOT. As part of this project, the winning design-build partnership will be tasked with replacing 558 bridges between the summer of 2015 and year-end 2017, and will be responsible for their maintenance for the next 25 years. Projects like this should be happening here in New York and on Long Island, says Herbst. After seeing the Governor s proposed budget, it s more important than ever that we begin working toward other solutions such as P3s to help keep our infrastructure strong and our economy growing. GCA Hosts The Road to Investment with NYSDOT Commissioner Joan McDonald The General Contractors Association of NY (GCA NY) continues its Speaker Series with a breakfast on Friday, February 6 th from 8 to 10 a.m. at The Yale Club in New York City. ARTBA-TDF Seeks Nominees for Young Executive Development Program Now in it s 20 th year, The American Road & Transportation Builders Association Transportation Development Foundation (ARTBA-TDF) is accepting nominations for its 2015 Young Executive Development Program (YEDP), being held April in Washington, D.C. This program provides rising leaders with a solid understanding of industry economics and explains how they and their company or agency can become politically engaged to help shape transportation policy. During this intensive two-anda-half days, participants will also have the opportunity to meet with their members of Congress about the need to fix the Highway Trust Fund and pass a long-term highway and transit investment bill.
