1 MINUTES OF THE SPECIAL MEETING OF THE PLANNING BOARD HELD ON WEDNESDAY, NOVEMBER 12, 2014 Meeting called to order at 7:30 P.M. Present: William Brown, Tom Freeman, Councilman Ryan, Paul Mathewson, Lawrence Lonergan, Jennifer Critchley, Melissa Collins, Victor Lugo, Michael Foley, Jim Helb, Township Engineer, Greg Mascera, Planning Board Attorney, Noreen Jones, Assistant Township Engineer Absent: Jim Kirby Pledge of Allegiance: Public Participation: Chairman Brown asked if any members of the public had any questions regarding any non-agenda items. Seeing none, Chair closed Public Participation. Consistency Determination Board of Education High School Project: Music Room: Mr. Douglas Kovats, Attorney with Kenney, Gross, Kovats & Parton, Attorneys At Law, The Courts of Red Bank, 130 Maple Avenue/Building 8, Red Bank, New Jersey and is representing the Verona Board of Education stated they will be starting with the Capital Review of the Music Room. Mr. Kovats stated that Mr. Kurt Schmidt of Mylan Architectural Group will testify. Mr. Mascera stated for the record that he has previously been a client of Mr. Schmidt s but that has no bearing on this hearing. Mr. Schmidt stated his qualifications and is sworn in by Mr. Mascera. Mr. Schmidt stated that he has been retained by the Verona Board of Education to prepare documents and drawings for the two additions to the High School. Mr. Schmidt stated one addition will be at the main entryway with a security vestibule and the other will be adjacent to the existing music room wing essentially doubling it in size.

Mr. Schmidt stated that the project has been submitted to the Department of Education in Trenton and has gone through the preliminary review and approval and is underway now to completing construction documents before the end of the year. Mr. Schmidt stated as part of this project before the Board tonight they are taking a cursory review so that the Board and public can see what they are doing and they can take into consideration any recommendations that the Board may express. Mr. Schmidt stated the drawings he is referencing here tonight are the same as the ones presented to the Board. Chairman Brown marked into the record Exhibit A-1, Site Plan and Floor Plans for proposed Music Room Addition, Drawing A1.01 by Kurt Schmidt of Mylan Architectural Group dated 10/31/14 and Exhibit A-2, Site Plan and Floor Plans for proposed Music Room Addition, Drawing A1.02 by Kurt Schmidt of Mylan Architectural Group dated 10/31/14. Mr. Schmidt stated that the addition will be brick to match the existing building and the roof height will be matching as well. Mr. Schmidt stated that the sidewalk currently there that runs in front of the music wing will be reconfigured to match the addition and they will also be putting in code compliant stairs and an ADA compliant ramp. Mr. Freeman asked if there will be any new lighting. Mr. Schmidt stated no. Mr. Mathewson asked about the security vestibule and how that would work. Mr. Schmidt stated that once the children are in it would be locked. Councilman Ryan asked about the acoustics and if there would be any sound muffling inside the walls. Mr. Schmidt stated they will be putting in acoustic tiles and the walls will be masonry with 3 inches of thermal insulation, there will also be less windows than there are now so that will reduce the amount of sound emitting from the structure. They will also be putting in new ceilings and floor finishes.

Mr. Helb stated that this is a consistency determination and asked Mr. Schmidt if he had reviewed this plan in relation to the Verona Master Plan. Mr. Schmidt stated he has not personally. Mr. Helb asked if Mr. Schmidt could address the impact on the neighborhood. Mr. Schmidt stated the impact will be a positive one and the projected addition will not be impacting on any residences. Mr. Helb asked if this was an independent project. Mr. Schmidt stated there will be some separate bidding out of projects such as doors and masonry, heating and such, but as far as any additions this is the only one. Mr. Schmidt stated there will also be some heating system improvements with this project as it is cold and drafty. Mr. Schmidt stated wall lights will remain with lighting canopy and the street lights. Chairman Brown asked Mr. Schmidt why the Board of Education wants to do this project. Mr. Schmidt stated that they have a large and growing music program. Mr. Helb stated that the plans need to go before Trenton and the Construction Code Official and make zoning code available and indicate on the drawings. Mr. Schmidt stated they will be part of the construction documents. Mr. Helb stated his only concerns are the drainage issues. Chairman Brown marked into the record the following Exhibits. Mr. Helb asked Chariman Brown if they could incorporate into the vote the testimony of Mr. Schmidt and the drainage plans being relocated. Chairman Brown stated yes that would be incorporated. Mr. Mascera stated for the record that the vote would then be that the music room is consistent with the Master Plan with the relocation of the drainage and the zoning table included as per Mr. Helb s request. Motioned by Ms. Critchley. S/nd Ms. Collins. All in favor. Mr. Mascera asked if any of the Board Members had any additional comments with regard to the style of the addition that the Board would like him to incorporate into the Resolution. Chairman Brown polled the Board and there were no other comments. Consistency Determination Board of Education High School Project: Synthetic Turf Field, Tennis Courts and Parking Area Chairman Brown stated that the next part of this hearing would be the Synthetic Turf Field, Tennis Courts and Parking Area. Mr. Kovats stated he has several witnesses that he has brought this evening on behalf of this portion of the hearing including Mr. French, PE, VP, Director of Civil Engineering of French and Parrello and Rui Dionisio, Superintendent of Schools.

Mr. Mascera stated that before Mr. Kovats presents witnesses that Mr. Robert Simon, Attorney for a group of residents called Be a Good Neighbor has some preliminary objection issues and called on Mr. Simon so they can get those issues addressed and disposed of and proceed accordingly. Robert Simon, Attorney Herold Law, 25 Independence Boulevard, Warren, New Jersey stated he has been retained to represent the group called Be a Good Neighbor that consists of Barbara Bochese and Steven Danieli of 9 Dodd Terrace, Daniel and Diane DePalma of 10 Dodd Terrace, Diane Braschi of 22 Dodd Terrace, Marc Kaplan of 137 Grove Avenue, the Ruberto family of 24 Dodd Terrace and Daniel Motley of 125 Franklin Avenue. Mr. Simon stated his qualifications and is sworn in. Mr. Simon passed out copies of a letter to the Board with attachments and entered into the record as Exhibit C-1, Letter from Robert Simon, Esq. dated 10/31/14 with attachment of letter dated 6/17/14 which contain jurisdiction and relevant matters. Mr. Simon stated that the music room project is a school facilities project and he has no objection to that, however the project that is coming up now, the synthetic field, field lights, tennis courts are not in the New Jersey Administrative code and is inappropriate and this project is subject to a full review as a major site plan and a submission of the zoning table and a survey which has not been submitted to date. Mr. Simon stated under the circumstances and some of the information that has been omitted by the Board of Education, on behalf of his client s he feels they should not proceed for a capital review. Mr. Mascera stated that the applicant will be held to the zoning ordinance and a site plan review but why does Mr. Simon think that the Board this evening cannot go through a courtesy review. Mr. Simon stated that he felt that if the Planning Board heard this tonight and made a determination as to if this is consistent with the Master Plan there could be a conflict if this comes back before the Planning Board for a site plan with bulk variances which would have the same witnesses and similar analysis.

Mr. Kovats disagreed with Mr. Simon and stated he felt the Planning Board could hear tonight and are not seeking any relief from the Board tonight. Mr. Simon stated that that would not be fair to the general public as the application has to go before a Township Board and they would be hearing the same testimony all over again. Mr. Mascera stated that a full review would take the Township s Zoning Code into account and determine if any variances or exceptions to the ordinances would be required which are not part of this evening s consistency review. Chairman Brown asked the Board for discussion on whether or not to hear the school district s proposals for consistency. Mr. Mascera stated that the Board does run the risk of hearing the same testimony twice. Mr. Lonergan stated that could be a huge waste of the Planning Board s resources if that were the case. Mr. Helb stated he is concerned that if the Board does hear this evening it could prejudice the Board s actions at the later date. Chairman Brown asked for a motion if the Board should not hear testimony tonight. Motioned by Mr. Lonergan. S/nd Mr. Lugo. All in favor with the exception of Ms. Critchley and Ms. Collins. Mr. Mascera stated he will be writing a letter to the Commission of Education. Chairman Brown reminded the Board of the next regularly scheduled Planning Board Meeting on Thursday, December 4, 2014 regarding DMH2, LLC, 176 and 200 Bloomfield Avenue.
