PLEDGE Commissioner Ahern led the Pledge of Allegiance. AGENDA AMENDMENTS There were none.

2 PRESENTATIONS / AWARDS There were none. PUBLIC HEARINGS There were none. CONSENT AGENDA 1. Approved payment of County Warrants. (Exhibit A) General Fund: EMS: 1919 Intergovernmental Radio: Buckhead Ridge Utility: 0206 SHIP: Approved the Minutes of the October 13, 2015 Regular Meeting. 3. Approved the Minutes of the October 26, 2015 Regular Meeting. 4. Acknowledged Receipt of the 2015 Annual Financial Reports. 5. Law Enforcement Trust Request (Sheriff Stuart Whiddon); $134,803 from Law Enforcement Trust Fund /2016 Budget Transfers. (Exhibit B) Commissioner Storter Long questioned the Sheriff s request for matching funds for federal grants. County Manager Carlisle stated he did not have any background information regarding this request. Commissioner Storter Long stated she would like to know what federal grants these funds were being used for. ON MOTION of Commissioner Storter Long seconded by Commissioner Ahern the Board approved the Consent Agenda items. BUSINESS AGENDA 7. Proclamation Proclaiming November 23 rd 29 th Childhood Cancer Awareness Week in Glades County Commissioner Storter Long asked if the organizations requesting this proclamation were non-profit organizations. County Manager Carlisle stated he believed they were. 2

3 Chairman Stanley stated cancer was the leading cause of death by disease among children in our country today. He stated this tragic disease was detected in nearly 15,000 of our country s young people each and every year. He stated the Kids Cancer Connection, Inc. and the American Cancer Fund for Children, Inc. were founded over 20 years ago and provided a variety of services to children undergoing cancer treatments. ON MOTION of Commissioner Ahern seconded by Commissioner Beck the Board approved a Proclamation declaring November 23 rd 29 th Childhood Cancer Awareness Week in Glades County. Chairman Stanley read the following proclamation into the record: Proclamation Glades County, Florida recognizing Childhood Cancer Awareness Week in Glades County November 23 rd 29 th WHEREAS, Kids Cancer Connection, Inc. and American Cancer Fund for Children, Inc. report cancer is the leading cause of death by disease among U.S. children between infancy and age 15. This tragic disease is detected in more than 15,000 of our country s young people every year; and WHEREAS, one in five of our nation s children loses his or her battle with cancer. Many infants, children, and teens will suffer from long-term effects of comprehensive treatment, including secondary cancers; and WHEREAS, founded over twenty years ago by Steven Firestein, a member of the philanthropic Max Factor family, the Kids Cancer Connection, Inc. and American Cancer Fund for Children, Inc. are dedicated to helping these children and their families. WHEREAS, Kids Cancer Connection, Inc. and American Cancer Fund, Inc. provide a variety of vital patient psychosocial services to children undergoing cancer treatment at St. Joseph s Children Hospital of Tamp, All Children s Hospital in St. Petersburg, as well as participating hospitals throughout the country, thereby enhancing the quality of life for these children and their families; and WHEREAS, Kids Cancer Connection, Inc. and American Cancer Fund for Children, Inc. also sponsor Courageous Kid Recognition Award ceremonies and hospital celebrations in honor of a child s determination and bravery to fight the battle against childhood cancer. 3

4 NOW, THEREFORE, BE IT PROCLAIMED, that the Board of County Commissioners of Glades County, Florida in a regular session, duly assembled, does hereby proclaim November 23 rd 29 th, 2015 as CHILDHOOD CANCER AWARENESS WEEK 8. Encumber SHIP Funds ON MOTION of Commissioner Beck seconded by Vice Chairman Pryor the Board approved the encumbrance and expenditure of up to $15, of SHIP funding for Applicant #2015-DPA-6 and authorized the Chairman to execute the Mortgage and Loan Agreements. 9. Grant an Extension for Down Payment Assistance County Manager Carlisle stated the Board had approved this applicant s request for down payment assistance in June; however, the applicant had not been able to close within the 90-day deadline. He asked that the Board extend the funding granted in June for another 90-days. Commissioner Beck asked if there was a responsible expectation that this loan would close. Mary Ann Whitney, SHIP Coordinator, stated the closing was scheduled for November 16, ON MOTION of Commissioner Beck seconded by Commissioner Ahern the Board approved a 90-day extension of the deadline for the encumbrance and expenditure of up to $15, of SHIP funding for Applicant #2015-DPA-3 and authorized the Chairman to execute the Mortgage and Loan Agreements. 10. Annual Report for the State Housing Initiatives Partnership (SHIP) Mrs. Whitney, stated the 2013/2014 funding had come from a different funding. She stated SHIP usually allowed 3 years to close out; however, this year was cut a little short. Commissioner Storter Long commended Mrs. Whitney on the excellent job that she did with the SHIP program. Vice Chairman Pryor agreed and stated Mrs. Whitney did an outstanding job. Mrs. Whitney thanked the Board. 4

5 ON MOTION of Commissioner Beck seconded by Commissioner Storter Long the Board accepted the SHIP Annual Report for FY 2013/2014 for close out (Allocation). 11. Disposition of the Glades InnCounty Manager Carlisle stated at the October 26 th meeting the Board had directed staff to draft a Request for Proposal for the sale of the Glades Inn. He stated staff had indicated that they would also bring back some potential uses that were allowed in that zoning district. He stated the Board would have an opportunity to define the uses because of the way the property was being sold. Commissioner Storter Long questioned number 4 Extended stay as part of a Motel/Hotel. Residential apartments will not be considered. She asked if the Board would have the right to limit how long the extended stay would be. She stated she realized people who were working on a job for several months may want to rent the room for 3-4 months; however, she saw the potential for this to be abused. She stated that she believed Motel/Hotel would be the highest and best use for the property and would be her priority use. She stated Attorney Pringle had confirmed that the Board could control what was built there by the building permits. County Manager Carlisle stated he believed the Board could put a 30-day limit on the extended stay. He stated usually individuals that were staying at the motel because of a job went home on the weekends so they were not staying continuously. Attorney Pringle stated the extended stay concept was in a large way related to the construction industry. He stated the time frame was usually 6 months. He stated it would be up to the Board what time frame they wished to use. Commissioner Storter Long asked how the rest of the Board felt about the listed uses. She asked if the Board was going to allow any or all of the uses combined (except for the Grocery Store). Commissioner Ahern stated he assumed it would be that way. He stated his preference would be that the property be used as a Motel/Hotel with a restaurant and lounge. He stated he would also like to limit the extended stay provision. Commissioner Storter Long stated a conference center had also been mentioned in the past. Attorney Pringle stated the Board could add some language that would indicate that the other uses mentioned were ancillary. He stated the Board could indicate that they wanted the primary use to be Motel/Hotel/Convention Center and make all of the other uses ancillary. He stated if the Board did not indicate that the other uses were ancillary then 5

6 there was a possibility that someone may come along and want to develop the property as professional offices only or a restaurant only. Commissioner Storter Long suggested changing the language in item 2 Restaurant to include as part of the Motel/Hotel. She suggested limiting the extended stay to 6 months and making Item 5 - Professional Offices an ancillary use. County Manager Carlisle stated he had added the Grocery Store use in case Winn Dixie of Publix wanted to come in and build a new store. Commissioner Beck asked what would prevent the temporary tenants from checking out at 6 months and then checking back in the next day for another 6 months. Attorney Pringle stated if the Board wanted to limit the stay to a 6 month non-renewable stay then they would need to be specific with the language. Commissioner Beck suggested adding an Assisted Care Living Facility to the list of allowable uses. He stated this would bring doctors and nurses into the community. Chairman Stanley stated this would be something to consider. Commissioner Storter Long stated these types of facilities were definitely needed in the area but felt that this would not be the highest and best use for the property. Chairman Stanley reminded the Board that these types of facilities would most likely be tax exempt also. ON MOTION of Commissioner Storter Long seconded by Commissioner Ahern the Board moved to allow the following uses on the property formerly known as the Glades Inn as provided for in the current zoning district, any other uses will not be considered: 1. Motel/Hotel (ancillary Convention Center) 2. Restaurant as part of the Motel/Hotel (ancillary) 3. Lounge as part of the Motel/Hotel (ancillary) 4. Extended stay as part of Motel/Hotel with a 6 month non-renewable term. Residential apartments will not be considered. 5. Professional offices 6. Grocery store. There was a brief discussion regarding the 6 month non-renewable term for the extended stay. County Manager Carlisle stated the extended stay violations would be complaint driven. He stated County staff would not be going into the motel and checking their books to see 6

7 who had over stayed the 6 months. He stated if County staff received complaints that there was no rental spaces available because of long term residents then Code Enforcement could step in. Raoul Bataller, Hendry Glades Sunday News, reminded the Board that this same thing happened in Hendry County with the Oxbow Inn. He stated St. Matthews had been denied at first and then had approached the Board impersonating a convention center. He stated the feeling in Hendry County was that the building was now being used as an alcohol rehabilitation center. He stated he had heard that St. Matthews was looking for other spaces to do the same thing with. Tracy Whirls, Executive Director EDC, asked if there would be a problem if someone wanted to come in and demolish the existing building and re-build a new hotel. County Manager Carlisle stated this would be allowed. Mrs. Whirls asked the Board if they had given any thought for the potential uses of the smaller parcel that had been separated out. County Manager Carlisle stated they had not. He stated the parcel was zoned commercial. Mrs. Whirls asked if any kind of reserved bid would be placed in the RFP. Commissioner Storter Long stated the County would have the right to refuse. Vice Chairman Pryor asked if there would be a time constraint on building or refurbishing the old building. County Manager Carlisle stated pursuant to the RFP the bidder would have to provide their business plans for the property, costs to buy, and a date certain when they would be open for business. He stated the Board would take all of these things into consideration when awarding the bid. 12. SHIP Foreclosure - Yates Attorney Pringle stated the Board recently discussed the SHIP program and its foreclosure of certain mortgages and notes that were in default. He stated one of the cases being discussed was the Yates parcel. He stated this parcel has an Agreement for Deed (with Mrs. Jewel Baker) in the amount of $15, that holds a priority interest over the SHIP mortgage. He stated the Board s options were outlined in the agenda summary. He stated the Board could pay Mrs. Baker in full for her Agreement for Deed and then proceed with foreclosure. He stated this option would also require the County 7

8 to pay the outstanding taxes. He stated the second option would be to make Mrs. Baker an offer less than the total amount due on the Agreement for Deed. He asked that the Board not discuss what number would be offered. He stated the Board could give him authority to negotiate a lower dollar amount to pay Mrs. Baker. He stated this option would still allow the Board to foreclose on the SHIP mortgage. He stated the Board s final option would be to not do anything with the property and make no offers to Mrs. Baker. He stated Mrs. Baker may or may not then foreclose on the property. Commissioner Storter Long stated the Board would have to pay Mrs. Baker (some amount), the taxes, and the cost of foreclosure. She stated she did not believe it would be prudent for the County to go this route. She stated if Mrs. Baker foreclosed on the property at least the County would get the tax money. She questioned the SHIP mortgage still being paid at a foreclosure sale. Attorney Pringle stated Mrs. Baker could extinguish the SHIP mortgage through her foreclosure process. Commissioner Beck suggested wishing Mrs. Baker luck and letting her pay the taxes and foreclose on the property. Commissioner Storter Long stated if doing this would not affect the County s points in getting another SHIP grant she would agree with Commissioner Beck. Attorney Pringle stated he had reviewed the program documents and could not find where the County was mandated to foreclose upon default occurring. He stated he did not believe there would be an adverse effect. Commissioner Storter Long asked if the amount of the SHIP mortgage was pro-rated over the years. Attorney Pringle stated this was correct; however, in the event of default, the entire amount was due. Mrs. Whitney stated some of the mortgage documents for SHIP and CDBG were written differently so you would have to look at each individually. Attorney Pringle stated this would become significant when the foreclosure process started. He stated the first step would be to send a letter to the borrower indicating that they were in default. He stated the borrower would have 30 days to object if they did not agree. He stated the borrower could pay the amount due in full. He stated the balance amount would also be important at the foreclosure sale because it would be the County s opening bid. 8

9 Commissioner Beck reminded the Board of the condition of the property and stated it would take $30, or better to renovate the home so that it could be marketed. Mrs. Whitney stated the owners had cleaned a little. Vice Chairman Pryor suggested allowing Attorney Pringle to negotiate with Mrs. Baker and see if the County could get the property for less. He stated it would be worth trying to foreclose and recover some of the SHIP funds. Commissioner Storter Long agreed. Commissioner Beck stated the County would still be using General Fund money to make this happen. County Manager Carlisle clarified that if the property sold at foreclosure sale, any funds used from the General Fund would be recovered and any excess would go back into the SHIP program. He stated the County could potentially gain its money back but would have to wait until the property sold. Commissioner Ahern stated he would prefer to negotiate with Mrs. Baker. Commissioner Storter Long agreed and stated Attorney Pringle should go ahead and send the 30 day letter to the owners. Attorney Pringle stated the taxes would ultimately drive the time frame for negotiations. He stated if someone applied for a tax deed the process would be sped up. Commissioner Storter Long questioned someone getting the property at a tax deed sale. County Manager Carlisle stated that in this case the SHIP mortgage would survive a tax deed sale and the new owner would be responsible for paying the mortgage. Attorney Pringle stated this was a very unique set of circumstances. He stated Mrs. Baker s mortgage would be extinguished by a tax deed. He stated the County s mortgage would survive. He suggested that if the property went to tax deed sale that the advertisement disclose that the SHIP mortgage would survive the sale and would be due and payable. It was the consensus of the Board to have Attorney Pringle negotiate with Mrs. Baker for a reduced figure on her mortgage and to issue the 30 day notice to the owner telling them that they were in default. Commissioner Beck asked if the time Attorney Pringle would spend on these negotiations were included in his monthly retainer. He cautioned the Board about spending so much 9

10 money on attorney fees and costs with the chance that no money would be regained in the end. Attorney Pringle stated litigation was not covered under his retainer and the County would be charged extra. Commissioner Beck stated he was against negotiating with Mrs. Baker. The rest of the Board wished to negotiate. Chairman Stanley called for public comment. There was none. ON MOTION of Commissioner Storter Long seconded by Commissioner Ahern the Board continued this item until the next day meeting on December 8, 2015 and directed staff to bring back more information. Chairman Stanley suggested that someone review the SHIP applications and not approve them if the owners already had a mortgage in place on the property. Mrs. Whitney stated she had started doing this. She stated she rejected the applications if there was a mortgage on the property. CONSTITUTIONAL OFFICERS There was no discussion. COUNTY ATTORNEY There was no discussion. COUNTY MANAGER County Manager Carlisle stated he had met with U.S. Fish & Wildlife on Friday regarding some conversations on panther corridors and zones. He stated they had tentatively agreed to discuss and define exactly what U.S. Fish & Wildlife needed from the county instead of painting the county with a broad brush. He stated they would also discuss how the program would be managed and how they would attempt to move the panthers into Georgia and the Carolinas. He stated that in the past, U.S. Fish & Wildlife had used old tracking devices and locations to define the panther dispersal zones and corridors. He stated if the zones could be defined then the properties outside of these boundaries would not be subject to the restrictions and credits (if both the County and the U.S. Fish & Wildlife agreed). He stated some areas such as the Muse Village and the Industrial Park area had been defined as off limits to panthers. He stated Hendry County had also defined several areas. He stated U.S. Fish & Wildlife was also alright with the area east of the BOMA property not being included in the program. He stated he believed some 10

11 progress had been made and he would keep the Board apprised. He stated he also discussed getting some political support from the U.S. Fish & Wildlife. He stated if the panther was such a valuable resource for the state and they wanted to use Glades and Hendry Counties to mitigate it then everyone in the state should have to subsidize the program for our lost revenues. He stated he and Vice Chairman Pryor had attended a meeting yesterday afternoon with South Florida Water Management in Okeechobee regarding land leases and what they would do to manage the processes better. He stated that Ray Palmer had made a presentation to the SWFMD about the BOMA lease with IFAS. He stated IFAS had indicated to the Commission at a previous meeting that the lease would be used for citrus greening research. He stated IFAS had now changed the proposal to water quality testing only. He stated he understood that the County Commission was willing to support the BOMA lease if it was going to help offset the devastation of the citrus greening. He asked for direction from the Board. Chairman Stanley suggested contacting IFAS and confirming this change. He stated if this was the case he would suggest rescinding Board support of the lease. Commissioner Storter Long agreed. Vice Chairman Pryor agreed. Chairman Stanley stated he was an employee of the Water Management District and would abstain from any vote regarding support of the lease. Commissioner Ahern agreed that if IFAS s intent had changed he would not be in support of the lease. Attorney Pringle stated if the Board s official action regarding this matter was going to change then they would need to add this item as an amendment to the agenda and as a Business Agenda item. ON MOTION of Commissioner Storter Long seconded by Commissioner Beck the Board amended the agenda to add a discussion regarding the BOMA property/ifas lease. Chairman Stanley clarified that he could vote on the amendment. Attorney Pringle stated this was correct. 13. Discussion BOMA Property/IFAS Lease Agreement 11

12 County Manager Carlisle asked for direction from the Board. He asked if the Board wanted him to find out if it was still IFAS s intention to do greening research and if not, did the Board wish to rescind their previous support of the lease agreement. Commissioner Storter Long suggested rescinding the support if it did not include citrus green research as part of the primary project. Attorney Pringle stated the Board could further clarify by Board action today that if the agricultural research including citrus greening was no longer a primary element of the BOMA lease and use then the Board would rescind its support of IFAS leasing the BOMA property and request that the property be declared surplus land so that it would go back on the tax rolls of the County. ON MOTION of Commissioner Storter Long seconded by Commissioner Beck the Board clarified their previous made motion as follows: if the agricultural research including citrus greening was no longer a primary element of the BOMA lease and use then the Board would rescind its support of IFAS leasing the BOMA property and request that the property be declared surplus land so that it would go back on the tax rolls of the County. Chairman Stanley called for public comment. Raoul Bataller, Hendry Glades Sunday News, suggested that the Board contact Dallas Townsend or Hugh English to clarify the lease terms. Motion carried by 4 0 vote. Chairman Stanley abstained from the vote. (See Exhibit B) County Manager Carlisle stated the County had made the final list for the $50, grant from the South West Florida Community Foundation for the Training Center. He stated he would be giving a presentation to them on Thursday. He stated if the County was awarded the funds they would be used to pay for the telephone system and the visual aid equipment in the classrooms. He stated he believed the biggest factor for Glades County getting support was the collaboration with all of the different colleges and communities. He stated the Board had approved the management agreements for the Community Associations on October 9, He stated the Ortona Community Association had asked for several things. He stated when they originally built the building they did not want to allow pets in the park area. He stated they were now asking to remove this restriction. He stated he not recommend allowing this until a management agreement was in place along with insurance to lessen the liability. He stated Mrs. Whitney had checked with PRM regarding this issue and they did not seem to have an opinion either way and said it would be up to the Board. 12

13 Commissioner Storter Long explained the reason for Ortona s request. She urged the Board to adopt the policy that no pets were allowed until such time that each association signed their own rules and accepted liability. County Manager Carlisle voiced concerns with pets at a playground but stated the final decision would be up to the Board. Vice Chairman Pryor expressed concern with the liability to the County. Attorney Pringle stated the minutes could be sufficient until the Board adopted a written policy. It was the consensus of the Board to prohibit pets on County property other than service animals. Chairman Stanley asked if the Community Associations would be able to make their own rules when they signed the agreement. County Manager Carlisle stated the Community Associations would have to negotiate with the Board regarding the agreement and the final direction would be from the Board. Attorney Pringle stated until each Community Association entered into a management agreement the buildings were still County property subject to all County rules and the control of the County. There was a discussion regarding animals left in vehicles. County Manager Carlisle stated he had been in some discussion with the Washington Park and Ortona Community Associations regarding noise and the flooring in their buildings. He stated some research had been done on vinyl and wood flooring and the associations had asked the Board to pay for half of the expenses. He asked if this was something the Board wanted to consider. Commissioner Storter Long stated it would cost approximately $11, to install the new flooring at Ortona and the association was asking for half. Chairman Stanley stated he did not have a problem with getting some prices or considering the payment of half. County Manager Carlisle stated the Board may be able to use one cent funds for this project. Commissioner Storter Long asked what kind of flooring had been placed at the Indian Hills building. 13

14 County Manager Carlisle stated the same flooring that was in the building before had been used. Commissioner Beck questioned adding funds to Lakeport s Community Association account. It was the direction of the Board to research pricing for the flooring at the Washington Park and Ortona Community Association buildings. Commissioner Storter Long asked if any funds were left over after the construction of the Emergency Operations Center. County Manager Carlisle stated there were no funds left after construction. Commissioner Storter Long questioned the purchase of a $2, home gym, $ feather peacock ribbon, $ elliptical, and an $88.00 red mosaic vase. She asked where the funding had come from. County Manager Carlisle stated the funds came from grants. Commissioner Storter Long stated she did not understand why these items were being purchased. County Manager Carlisle stated there was a gym in the building and would be used by employees only. DEPARTMENT HEADS Tracy Whirls, Executive Director Glades County EDC, reminded every one of the upcoming Rural Summit in Orlando on November 15-17, She stated there would be a working issues discussion group held on Sunday afternoon. She stated she expected to discuss some potential legislative issues for rural Florida. She stated volunteers would be recognized, including a Glades County resident. She stated they would also be honoring Legislative Representatives from each of the 3 areas of rural economic concern. She stated there would be some interesting site consultant presentations on Tuesday. She stated the EDC had released their newsletter yesterday. She stated the response to the piece that the South Florida Community Foundation had done on the Training Center had been phenomenal. She stated it had been posted on LinkedIn and had 34 views/reads. She stated the news release had also been sent to 40 consultants and Enterprise Florida. She stated 4 of those consultants had contacted her. She stated the closer the Training Center was getting to being shovel ready, the more interest we were getting. PUBLIC INPUT ON NON-AGENDA ITEMS There was none. 14

15 COMMISSIONERS ITEMS AND COMMENTS Commissioner Ahern stated the Veteran s Dinner had turned out really good. He stated it had been a success. He stated the Army Corps of Engineers had cleaned up some stuff at the campground and he hoped to get the RFP for lease out soon. He stated the Glades Youth Livestock Association would be hosting a circus in January and there would be a Junior Rodeo held after Chalo Nitka. Commissioner Storter Long stated 130 people, of which 55 were veterans, had attended the Veteran s Dinner. She reminded everyone that there would be a Veteran s Day ceremony held at the Ortona Cemetery at 11:00 a.m. on Wednesday, November 11 th. She stated Trish Yount, BHR VFW Post Commander 9528, would be the guest speaker. Chairman Stanley reminded everyone to attend a Car Show on Saturday from 8:00 a.m. 4:00 p.m. at the Buckhead Ridge Community Association building. ADJOURN ON MOTION of Commissioner Beck seconded by Vice Chairman Pryor the Board adjourned the meeting.
