2 1 Q This is Nxxxxx Hxxxx with the Child Protective Team. 2 Today is February 8 th, 2008 about 9:30am. 3 I am going to interview [victim #1], date of birth 4 7/10/1998 and [B.M.], 2/18/03. 5 [0:00:31 Interviewer leaves the room] 6 [0:01:11 Interviewer and witness enter the room] 7 Q Alright, here you go. Do you want to have a seat 8 there for me? 9 A Is it close to lunchtime because I m hungry? 10 Q You re hungry? Did you have breakfast this morning? 11 A Yeah. 12 Q Yeah? What d you have? 13 A Pops. 14 Q Pops, yeah. Do you remember, um, what my name is? 15 A Nxxxxx. 16 Q Yeah, very good. And you re [victim #1], right? 17 A Um-hum. 18 Q Cool. And how old are you, [victim #1]? 19 A Nine. 20 Q Nine years old? 21 A Um-hum. 22 Q What grade are you in? 23 A Fourth. 24 Q Fourth grade. And how s fourth grade going? 25 A Do -- doing good until the FCAT s come in. 2

3 1 Q Oh, the FCAT s. When do they start? 2 A Um, next week. 3 Q Next week. So, you ve been practicing and lot, uh -- 4 A Yeah, my nan s been crazy about it. She s like, 5 writing comp this and writing comp that. 6 Q Mmm, so 4 th grade is the writing one, huh? 7 A Um-hum. 8 Q Yeah. 9 [Witness goes through coloring sheets on the table] 10 Are you looking for -- you looking [unintelligible]. 11 How do you do in school? Do you get good grades or A Uh-huh. 13 Q Yeah. 14 A Because for some reason every single school year it s 15 A Honor Roll A/B, A, A/B Q Very good. 17 A -- it s, it s like a pattern for some reason. 18 Q Yeah. Do you have a favorite subject you like? 19 A Math and recess. 20 Q Yeah (giggles). Well I like math too. What kind of 21 math are you doing? 22 A Um, we re doing -- we re doing like angles and 23 symmetry. 24 Q Cool. Well what do you like to do for fun when you re 25 not in school? 3

4 1 A Play video games. 2 Q Oh, yeah. What kind of video games? 3 A Um, Pokemon. 4 Q Pokemon. 5 A Yeah, I love Pokemon. 6 Q Um-hum. What kind of game thing do you have? Do you 7 have a -- 8 A I have a -- 9 Q Playstation or? 10 A I have a Playstation 2, a Game Cube, a DS, a Game-- 11 a Gameboy DS -- I mean, a Nintendo Game -- I mean did I already, did I say Game Cube already? 13 Q Yes. 14 A A, um, a Nintendo 64, a DS, and a, um Gameboy SP, a 15 Gameboy Advance. 16 Q Oh my goodness. 17 A A Super Nintendo Q What do you do with all those games? 19 A -- and a Wii. 20 Q Oh, you have a Wii? 21 A Yeah. 22 Q Oh, wow. 23 A My grandpa got it for me for Christmas. 24 Q Oh, very cool. What s your favorite game on the Wii? 25 A Pokemon Battle Revolution. 4

5 1 Q Pokemon Battle Revolution? 2 A Um-hum. To get Pokemon on it you have to, um, you 3 have to have Pokemon Diamond and Pearl. I ve got both 4 of them. 5 Q Ah. 6 A I m trying to get Pokemon Chaos Black. 7 Q Oh, I don t know -- I just know about the boxing one 8 on the Wii. It looks really fun. 9 A I m already at skill level and - something. 10 Q You re what? 11 A I m already skill level and - something. 12 Q What does that mean? 13 A It means I m almost a pro. 14 Q Oh my goodness. 15 A Except -- except I keep losing points because it s hard. 17 Q Yeah. Wow. So that s a lot of video games. 18 A Yeah. I love video games. 19 Q Yeah. What s -- what s a DS? You said you have 20 a DS. What is that? 21 A Um, it s like a, um, prototype that you can play and 22 small -- small cartridges where you put and you can 23 play them and all that. 24 Q Oh, is it like a handheld one where you can bring it 25 with you -- 5

6 1 A Yeah. 2 Q -- like the Gameboy -- 3 A My mom has it in her pocket. 4 Q Oh, ok. Cool. Well good. Well I see that you have 5 a brother and sisters out there? 6 A Um-hum. 7 Q Yeah. 8 A My brother s always like (makes growling and snarling 9 noises. Flings arms). 10 Q Oh, yeah? He does that? 11 A He annoys me a lot. 12 Q So, I -- are you the oldest? 13 A Yes. 14 Q Yeah. How do you like being the oldest? 15 A Not very much. 16 Q No? How come? 17 A Because I m always getting beaten up. 18 Q You re getting beaten up? Who beats you up? 19 A My brother. 20 Q Your brother. What s your brother s name? 21 A [B.M.]. 22 Q [B.M.] Yeah. Do you and [B.M.] play together? 23 A When I try to play with him, like on the Wii, whenever 24 he doesn t win, he goes (make grumbling sound) then 25 he starts hitting me. 6

7 1 Q What do you do when he starts hitting you? 2 A I hit him back. 3 Q You do? Well. [victim #1], is it okay if I just tell you 4 about some, um, rules about talking in this room? 5 A Um-hum. 6 Q Yeah. You follow rules pretty good? 7 A Sometimes. 8 Q (Giggles) Yeah? Do you -- um, what s a rule at school 9 that you re -- that you need to follow? 10 A Be quiet. 11 Q Be quite, yeah. 12 A Do work. 13 Q (Chuckles) Pretty important rules. What about at 14 home? Do you have any rules that -- that you have to 15 follow at home? 16 A Don t hit. 17 Q Don t hit. Yeah, sounds like a -- sounds like a good 18 rule. Well the rules in here are not too tough, ok? 19 The first rule that I want you to know is that you are 20 not in any kind of trouble, okay? 21 A Um-hum. 22 Q And so whatever you would like to talk about you re 23 not going to be in any kind of trouble for what you 24 say in this room. 25 A I know. 7

8 1 Q You understand that? 2 A Um-hum. 3 Q Okay. The other rules is that whatever we do talk 4 about that I need it to be the truth. You only tell 5 the truth in this room. 6 A I always tell the truth. 7 Q You always tell the truth? What does that mean? What 8 does it mean to tell the truth? 9 A It means like don t tell any lies or add anything. 10 Q Right. It means to tell things that really happened. 11 A Um-hum. 12 Q Right? So, can we make a deal to only tell the truth 13 in here? 14 A Yeah. 15 Q Do you know why you had to come here today? 16 A To -- no. 17 Q Well, my job is, um A Is to keep stuff from kids and to keep them safe. 19 Q I talk to kids about their families and see how things 20 are going in their families -- with their families. 21 A And then figure something out? 22 Q Depends, like if A Like, can you figure it out today? Because my cousins 24 is going to be at my Amah s house today -- um, 25 tonight. And I want them to sleep over at my house. 8

Well, why don t you tell me a little bit 2 about your family or what s going on? 3 A Um, my dad he s been, um, being really mean with me 4 and yelling at us for like no reason a lot. 5 Q Oh, yeah. 6 A Um-hum, and once at a, um, store when B was acting out 7 he, um, he put B s hand onto the shopping cart and 8 squeezed his hand. 9 Q Oh, yeah. Is B -- is B [B.M.]? 10 A Um-hum. 11 Q Is that what you call him? Okay. 12 A We just call him B. 13 Q B, okay. 14 A So, I don t hope he acts like a bee. 15 Q Yeah. (Giggles). So what kind of stuff has your dad 16 been yelling at you about a lot? 17 A I don t know. He s been yelling at my brother a lot 18 because he s been acting out. 19 Q Yeah. And what -- what happened with his hand on the 20 shopping cart? 21 A My dad Q Can you explain that to me? 23 A My dad squeezed his hand against the shopping cart 24 really hard. 25 Q Oh, alright. 9

10 1 A (Makes noise when he gets marker on his hand) 2 Q Were you there when that happened? 3 A Yes. 4 Q Yeah. Was anybody else there? Did anybody else see 5 that? 6 A My mom was there, but I don t think she saw it. 7 Q Um-hum. What happens with your dad if, um, if you get 8 in trouble? 9 A With he, um, like sometimes he yells at me like, like 10 too much. 11 Q Yeah. But, what does he say when he s yelling at you? 12 A I forgot (chuckles). 13 Q You forgot. What sort of things or -- do you do 14 that that he gets mad or that he yells about? Like, 15 what s something you would do that he would yell at 16 you about? 17 A Like, hitting my brother when he saw that. And 18 sometimes when I talk too much, he yells at me. 19 Q Yeah. What does he say when you talk too much? 20 A He s like. [Victim #1] be quiet. 21 Q So does your dad -- does he live with you in the house 22 with you guys? 23 A Yeah. 24 Q Yeah. Did, um, did your dad ever hit you? 25 A No. 10

11 1 Q No? Did you ever see him hit any of the other kids? 2 A Well, he slapped [E.M.] s hand. 3 Q Oh, yeah? Can you tell me about that? What happened? 4 A Um, I don t really remember. 5 Q Um. 6 A I was like a lot of [unintelligible] -- like a week or 7 two weeks ago. 8 Q Yeah. Did you see him slap [E.M.]? 9 A Um, well, I heard [E.M.] crying and then -- well, 10 actually, I -- my dad, but -- I just keep forgetting 11 things. 12 Q That s okay. You just take your time. 13 A Because when, um, I was talking to, um, Axxxxxx [DCF]. 14 Q Um-hum. 15 A Um, I looked down on the paper and it said that 16 [E.M.] -- that my dad slapped her hand. And 17 usually [E.M.] doesn t say things if it isn t true. 18 Q Did you see your dad slap [E.M.] s hand? 19 A No. 20 Q Did your -- did you see your dad hit any -- any of 21 your A No. I only Q -- sisters or brothers? 24 A No. I only saw my dad, um, you know, squeeze my 25 brother s hand on the shopping cart. Sometimes he 11

12 1 does that to me. 2 Q Yeah. 3 A But, not that much to me. 4 Q Did you ever see your dad choke, um, your brother 5 or your sisters or did he ever do that to you? 6 A But he -- no, but he grabbed my brother in the back 7 of the neck. 8 Q Oh, yeah. 9 A Um-hum. 10 Q Where were you when that happened? 11 A I don t really remember. I don t think I even saw 12 that. 13 Q No? Well how -- how do you know about that? 14 A Because, um, because I heard B talking to Axxxxxx [DCF] 15 about that. 16 Q Oh, yeah? So how -- how do you feel, um, around 17 your dad? 18 A I feel scared. 19 Q You feel scared? What s -- what scares you? 20 A Like when he yells at -- at me and hurts my brother 21 and sister. 22 Q Did he ever hurt you? 23 A Only yelling. 24 Q Um, do you ever talk to your mom about feeling scared? 25 A Well, we talked -- one day. 12

13 1 Q Yeah. 2 A And, um. 3 Q And what did you say? 4 A Well, our dad was with us and he talked to us too. 5 Q Yeah. 6 A And he said maybe he--he-- it was part of his fault. 7 Q What was part of his fault? 8 A Like being mean and all that. 9 Q Then what happened after you had that talk? 10 A Then we had to go to our nan s house for a while 11 like [unintelligible] for a week or two days I mean not two days, two weeks I think. 13 Q Um. And what s it like staying at your nan s house? 14 A It s irritating because of that -- of her, you need 15 to do writing comps, you need to do writing comps Q You need to do writing comps? 17 A And then -- when then she says this, after your 18 writing, I m going to be your reading coach. And I m 19 like, oh wow, I m so excited (sarcastically). 20 Q So your nan s kind of, um, hard on the, um, the school 21 work? 22 A Yes. 23 Q Yeah. So how -- how do you want things to turn out 24 with your family? 25 A I just want them to be safe. 13

14 1 Q Who do you want to be safe? 2 A My family. 3 Q Yeah. Do you think they re safe now? 4 A Um-hum. 5 Q Who in your family do you want to be safe? 6 A Um, like my brother and sister, or sisters, and mommy. 7 Q Yeah. What do you -- what do you want them to be 8 safe from? 9 A My dad. 10 Q Yeah. What exactly do you -- does your dad do that 11 makes them not safe? 12 A Um, like, he hurts them. 13 Q Yeah. 14 A Um, like, my dad doesn t really hurt my mom. He 15 doesn t [unintelligible]. 16 Q He doesn t really hurt your mom? 17 A Um-mm. 18 Q Yeah. What does he do that hurts your brother or your 19 sisters? 20 A Like he -- for my brother he, um, puts his, um, my 21 brother s hand -- here s my brother s hand, here s his 22 hand (witness indicates one on top of the other). 23 Q Yeah. 24 A Like that. It doesn t make a cracking sound -- I did 25 break my finger once, but that was just an accident. 14

15 1 Q Yeah. 2 A And you know what -- you know what -- how it 3 broke? We were playing football and then I didn t 4 catch it. 5 Q Oh. So do you -- did you want your dad to keep 6 living in the house with you? 7 A Only if he -- only if he s -- he makes us -- only if 8 he does stuff that makes us safe. 9 Q Yeah. What could he do though, that ll make you safe? 10 A I don t know. 11 Q Yeah. Do you and your dad, um, do you guys do things 12 together? With just the two of you? 13 A No. 14 Q No? Does he do things with just the other kids? 15 A He doesn t really do anything with us. 16 Q No? What about your mom? How do you get along with 17 your mom? 18 A I get with -- along with my mom really good. 19 Q Yeah. You feel safe around your mom? 20 A Um-hum. 21 Q Yeah. 22 A Hey, I made a trapezoid! 23 Q (Giggles) 24 A You see, I made a trapezoid. 25 Q Yeah, I see. Yup. 15

16 1 A I did it, too. 2 Q (Chuckles). So, [victim #1], like I -- you know my job 3 is to talk with kids about their families and how 4 things are going. Is there anything that -- that you 5 want to talk about or that you want to share? 6 A No, no. 7 Q Is there anything about your family that you wish you 8 could change? 9 A Yes, if my dad could be nicer. 10 Q If your dad could be nicer? Okay. Anything else you 11 wish was different? 12 A That, like, that I could have my friends over and and like -- like have -- like see my cousins more. 14 Q Yeah. 15 A I barely get to see my cousins. 16 Q How come you can t have your friends over? 17 A Because, um, because he was, um, accused of being a, 18 um, doing something. He was accused -- he s -- he 19 was accused of being a sex offender. And the judge 20 says that he can t come -- um, that no kids can come 21 over. 22 Q Yeah. 23 A But Q Who was accused of being a sex offender? 25 A My dad. 16

17 1 Q What does that mean, a sex offender? 2 A I think it means that he touched someone, but he 3 didn t. 4 [Witness is drawing] 5 I m gonna be that one day. 6 Q Oh, yeah. What is that? 7 A An astronaut. 8 Q Yeah. 9 A And that s Earth. 10 Q So, you were saying the -- is that why you don t see 11 your cousins very much? 12 A Well he s -- well, our cousins live in like, um, 13 Jacksonville. 14 Q Um. 15 A We live in [Hyacinth subdivision]. 16 Q Yeah. 17 A And our other cousins that s coming down today is lives in Savannah. I never get to see them. I only 19 get to see them once or twice a year. 20 Q Um. So, what you -- what do you think about that, um, 21 about your dad being accused of a sex offense -- being 22 a sex offender? 23 A I think it s wrong because he -- because he didn t do 24 anything. 25 Q Did you -- did you ever talk to your dad about it? 17

I do good tails (witness is drawing). 4 Q How do you know your dad didn t do anything? 5 A Because I was with him on that day. 6 Q What day? 7 A I was with him, um, on the day he was accused. 8 Q Oh. 9 A Okay, this looks [unintelligible] (witness drawing). 10 Q Yeah. So, [victim #1], did -- have you ever talked to 11 anybody about, um, private touches? 12 A Um-mm. 13 Q No. Do you know what that -- what private touch 14 means? 15 A It means that you touched someone in the privates? 16 Q Yeah. And where are -- where are your privates? 17 A The front and back. 18 Q The front and back? Okay. Has anybody ever given you 19 a private touch? 20 A Um-mm. 21 Q Okay. Did you ever, um, give anyone else a private 22 touch? 23 A Um-mm. 24 Q Did you ever see anybody s, um, private parts? 25 A Um-mm. Except for when I -- except for when I go pee. 18

Did anybody ever, 2 um, show you private parts, um, like on a picture 3 or computer? 4 A Um-mm. 5 Q No. And what would you do if something like that were 6 to happen? 7 A I would tell my mom. 8 Q You would tell your mom, okay. Do you know if 9 anything like that happened with anybody else -- if 10 anybody else ever got private touches? 11 A (Shakes head negatively) I don t know anyone 12 that does. 13 Q Anybody ever tell you about that -- what happened 14 to them? 15 A (Shakes head negatively) 16 Q No. What about your brother or your sisters? Did 17 they ever talk to you about that? 18 A Um-mm (shakes head negatively) 19 Q No, okay. 20 A I m getting really hungry. 21 Q Okay. Um, [victim #1], do you mind just hanging out in 22 here for just a minute and I ll be -- I ll be right 23 back. We ll get you home. 24 A Okay. 25 Q Okay. Yeah, I hate doors. Your picture is 13 coming along good. So, you know what, [victim #1]? I ve 14 been asking you a lot of questions, haven t I? 15 A Um-hum. 16 Q Yeah (chuckles). Do you have any questions that you 17 want to ask? 18 A Um-mm. 19 Q No. Is there anything you want, ah, you want to share 20 or talk about? Anything on your -- on your mind? 21 A Uh-uh. 22 Q No. 23 A Only we having for lunch? 24 Q You re having lunch, yes. Well, we ll get to that 25 soon. Um, because like I said, you know, my job is to 20

21 1 talk to kids and see how things are going and also 2 make sure that that they feel safe in their home and 3 the different places that they go. Do you feel safe 4 at your home? 5 A Not with my dad. 6 Q Not with your dad. And what is it about being at home 7 with your dad that that makes you not feel safe? 8 A Like when he yells at us too much and makes like -- 9 and makes us feel like we re not like, we re not good 10 children. 11 Q Yeah. And what does he do or say that makes you feel makes you feel that way? 13 A Like he s -- like -- why do I keep forgetting things? 14 (Chuckles) I forgot. 15 Q You want to put those down and maybe it ll help you help you think better? 17 A Usually whenever I put things down they never help me 18 (chuckles). 19 Q Um. 20 A I really don t know -- anything that much anymore. 21 Q Yeah. 22 A I knew it on the way here. I think that movie 23 distracted me. 24 Q Yeah. Well, let me ask you this. If you -- if 25 something, whether it be your dad or anybody else, um, 21

22 1 were to do something that made you feel unsafe or 2 scared. What do -- what do you think you could do? 3 A Um, tell my mom. 4 Q Tell your mom. 5 A Sorry, I had scratched up your violin, now I 6 [unintelligible]. 7 Q And what -- what do you think your mom would do? 8 A I think she would do the best for us. 9 Q Yeah. 10 A What s best for us. 11 Q Have you told your mom that you -- you don t feel safe 12 with dad in the house? 13 A Um-hum. 14 Q Yeah. And what did she say? 15 A She said we ll go over here and -- and they ll figure 16 out. Can you, please? Thank you. If I say it. 17 Q What d you want -- what do you want -- what would you 18 like to see happen if we figure it out today? What do 19 you want to happen? 20 A (Shrugs shoulders with hands up) I don t know. 21 Q (Giggles) What do you want -- what do you want me to 22 figure out? 23 A I forgot (chuckles). Why do I keep -- why do I keep 24 forgetting? Um, figure out if he should stay or go. 25 Q What do you think? 22

23 1 A I don t want him to hurt any of us anymore. 2 Q Do you think he should stay or should he go? 3 A The second. 4 Q He should go. Why should he go? 5 A Because I don t want him hurting my family anymore. 6 Q Okay. What has he done to hurt your family? 7 A I keep -- I forgot again (chuckles) for the third 8 time. He grabbed my brother s arm and -- and went 9 like this (witness squeezes hand). 10 Q Yeah. 11 A And he, um, slapped my sister s hand. And he yells 12 at us a lot. 13 Q Anything else that hurt your family or hurts you? 14 A But, and he grabs my -- the back of my brother s neck. 15 Q Okay. Anything else? 16 A And he, um -- oh, did I already say the shopping cart 17 thing? 18 Q Um-hum. 19 A And that s it. 20 Q Okay. What do you think will happen if -- if your dad 21 does come -- stay in the house? What you think would 22 happen? 23 A He might still hurt us or he might harm us or st-- I 24 mean, like stop. I don t know. 25 Q Okay. [victim #1], did anybody talk to you about coming 23

24 1 here today -- about talking to me? 2 A Um, my mom just said, um, that to tell the truth. 3 Q Yeah. Have you told me the truth? 4 A Um-hum (nods head affirmatively). 5 Q Is there anything that you didn t tell me? 6 A (Shakes head negatively). 7 Q Did you -- did you tell me everything about all the 8 questions that I had asked? 9 A (Nods head affirmatively). 10 Q Did you make anything up or tell me any lies? 11 A Um-mm (shakes head negatively). 12 Q No. Did anybody tell you what to say or what 13 to tell me? 14 A Um-mm. 15 Q No. 16 A This is true. 17 Q This is true. Did your dad know that you were coming 18 to talk to me today? 19 A I didn t ask my mom that. 20 Q Have you -- have you talked to your dad since you, um 21 since you guys went to your nan s house? 22 A (Shakes head negatively). 23 Q Okay. Have you seen him since you came to your nan s 24 house? 25 A (Shakes head negatively). I have color on (witness 24

Like I said, I just want to make sure that 6 you re safe and that you stay safe and that if 7 anything were to happen that you know -- you know 8 what to do.
