Later in the day he was liberated on bail himself in 50 and two sureties in 25 each to appear on the 31 st instant. The chief case was a family squabble between William Slater and John Leckie, the former of whom was the son of Leckie s wife. Painful disclosures were made as to the relationship subsisting in the family, which both parties must be sorry for when their passions cool down. 4 costs or two months imprisonment, and thereafter to find two sureties in 25 each to keep the peace for six months. The case in which Slater was prosecutor was dismissed. (Reference National Library of NZ Daily Southern Cross Wednesday 01 February 1871) Daily Southern Cross Wednesday 01 February 1871 Police Court Friendly Relatives William Slater was charged on warrant by John Leckie with having violently assaulted him on the 17 th January by striking him and otherwise abusing him Prisoner pleaded not guilty Mr Keetley appeared for the prisoner and Mr Beveridge for the complainant John Leckie related to the circumstances of the quarrel. From his evidence it appeared that the prisoner was a son of complaint s wife that some two years ago plaintiff had gone to Sydney and from certain circumstances, which there came to his knowledge he decided to return to Auckland. Prisoner and complainant s wife wished to get him out of the road as he had letters in his pocket to show. On the evening in question as he was retiring to bed his bedroom was rushed by the prisoner. He was seized by the shirt by the prisoner who shouted You wretch I ll kill you. His shirt was all torn and was produced - a rather ragged and bloody garment. He was violently assaulted and from prisoner s threats, he was afraid that he would do him some grievous bodily harm. Frances Jones residing at Richmond, gave corroborative evidence. Plaintiff came to his house on the night in question with his shirt all torn; he was bleeding and bore many marks of having rough treatment. Dr Goldsbro gave evidence upon the nature of the wounds plaintiff had sustained. He had no appearance of having been drinking; other wounds had been lately inflected. This was plaintiff s case. Mary Leckie wife of plaintiff gave her version of the affair and said that one was a bad as the other. She dragged the sleeve out of the plaintiff s shirt, dragged him into the bedroom and locked him in, but he afterwards went out by the window. Had she known that he was going into town he would never have got out of the house. Crossexamined by Mr Beveridge, She did not like her son better than her husband. She was disappointed when he came back from Australia. She wished to get away from her husband, and to live with he son. She was outside the house when the squabble between her son and husband began. The two were scuffling when she went into the bedroom, the noise attracted her then. She could not say whether her son was drunk, he might have had a glass. Her son was very excited. She could not say that he son was ever in her husband s bedroom since his return from Australia. Mr Keetly re-examined after which the Court examined at some length. A cross action John Leckie was then charged by William Slater with having on the 17 th January violently assaulted him by striking him on the face &c Mr Keetley for the complainant and Mr Beveridge for the defendant. William engineer gave the particulars of the origin of the quarrel something about a block said to have been got from Thornton, Smith and Firth s mill. The evidence given was similar to that in the above case.- In cross examination it appeared that the ownership of the house in which the parties reside in Richmond was at the bottom of the dispute Counsel having address the Court the Magistrate retired to consider their decision. On their return the Chairman said In the case of Leckie against Slater the defendant is fined 2 and full costs and in default two months imprisonment and thereafter to find two sureties in 25 each to keep the peace for a period of six months. The case of Slater against Leckie is dismissed. Cause of death was enlargement and disease of liver 4 months as certified by Dr BAYNTUM. She was born Mary BROWN about 1818 in Dumfries Scotland. She was the daughter of a draper and parents recorded as John & Mary LECKIE which should have read BROWN. She married John LECKIE in Auckland at age of 46 years. She had resided in New Zealand for 17 years. The undertaker from Auckland Geo.
