Key Points in Scottish Research BMD - Registration began in 1855 Prior to this dependant upon Parish Records OPR's Parish records relate to the Established Church of Scotland Women never lost their identity consequently Woman's maiden name appears on birth, marriage and death certs. More information on Birth, Marriage and Death Certificates Census - dates are the same although questions asked vary.

Scottish Naming Patterns 1st born son - named after father's father 2nd born son - named after mother's father 3rd born son - named after father 4th born son - named after father's oldest brother or father's paternal grandfather 5th born son - named after mother's oldest brother or mother's paternal grandfather 1st born daughter - named after mother's mother 2nd born daughter - named after father's mother 3rd born daughter - named after mother 4th born daughter - named after mother's eldest sister or mother's maternal grandmother 5th born daughter - named after father's eldest sister or father's maternal grandmother

Scottish Kirk Session Records KS Minute records kept by Kirk Session Clerk about what went on in the Parish but refer to Established Church of Scotland the Free Church established. Kirk Session equivalent to Local council formed by local minister and kirk elders. Kirk elders were local gentlemen and farmers but not all fully educated. KSR's give great picture of a family in a local area. What the family did during the week. The reasons for the Sessions was to control behaviour and people could be fined. e.g. fornication was 1. The Kirk Session met in the Church rooms. They covered early life, working life and death. ScotlandsPeople plan to put Kirk Session Records (KSR's) online in the near future but not yet available. Worth keeping a lookout for. Early Life: Births and baptisms listed that are not in the OPR's. As much as 25% OPR's not transcribed. School fees listed and the move of a schoolmaster listed. Work Life: Going to Church elders kept a record of people who attended and so knew who did not attend. Visitation Lists: ministers visited every home and quizzed those over 8yrs old on knowledge of scripture. If they could not answer they were required to attend Sunday School. These Visitation Lists record families much like a census. But, references in KSR's to various matters: Pew fees 1783 reference to fee for a pew in church- average charge 1/6 per year. There are lists of names of people paying for pews otherwise had to stand. Horse Tax: 1797 government imposed taxes to pay for French and American Wars. 2/- for a large horse. Wig tax: Old Age: Care of the sick and elderly was the responsibility of the Church. No death records prior to 1855 and there are few death records in OPR's. However, Mort Cloth records. The Mort Cloth covered the body or coffin and Kirk charged for the use of this. People were embarrassed not to have a Mort Cloth and the names are listed. However: limits of KSR's in 1761 only 60% of people were members of the Church of Scotland. There were other Churches e.g The Free Church. Because so many left the Established Church of Scotland 60% of records not in Scotlands People War: The call to arms (e.g. 1688) was often announced from the pulpit and the Session Records list the names of men at arms

Accessing the National Records of Scotland In "Search box" put Name of parish in top box The "CH" in the 2nd box Then dates in 3rd box. CH2 Church of Scotland CH12 Episcopal Church CH17 Catholic church For all records for a parish enter "CH" then leave blank and all records of that area will come up.

The Scottish Poor Law. A member of the AngloScots Branch of the Society attended the WDYTYA Conference this year and, whilst there, attended a talk given by Dr. Patricia Whatley of Dundee University about the Scottish Poor Law. He obtained a copy of the handout that Dr Whatley produced. I found this to be so informative that I contacted Dr Whatley and obtained her permission to reproduce the handout for the magazine. Whilst the handout is in bullet point format, its content is clear. Five tips for using the Scottish Poor Law Dr Patricia Whatley, University of Dundee, Scotland There are differences between the Old and New Scottish Poor Laws. Be aware of the differences between the Scottish and English Poor Laws. There are a number of types of Scottish Poor Law Records. In Scotland there are Poorhouses, not workhouses, with distinctive records. They are located throughout Scotland. The "Old" Poor Law in Scotland , Scottish Poor Law Act, passed by the Parliament of Scotland, replaced previous Acts of Legislation, designed for the punishment of the strong and idle beggars and the relief of the poore and impotent". Parishes were each responsible, through the Kirk Session, for enumerating and managing their poor. The poor in Scotland had no automatic right to receive poor relief and their circumstances were investigated by the kirk session to determine whether they were "deserving" or "undeserving" poor. Poor relief was funded by o Church door and house collections o Voluntary "assessment" by the heritors (landowners o Mortcloth fees o Pew rentals o Baptisms o Fees for the proclamation of wedding banns Pressure on the "poors" funds was under increasing pressure during the later 18th and 19th centuries. The 1843 Poor Law enquiry investigated the "practical operation" of the poor law and how it might be amended. Gathered wide-ranging data on many aspects of working-class life, including unemployment, prices, wages, prudence and indigence, diet, and medical relief. The report and evidence revealed the extent of poverty and destitution evident throughout Scotland, and the paucity of medical assistance for the poor sick. The enquiry gathered detailed data on the sources of parish poor law income. The report, published in 1844, stated, "there is scarcely any provision made for medical relief to the poor out of the poors funds in Scotland. This seems to be left systematically to private charity". Prior to 1845 the poor were largely reliant on the charity of those doctors that existed, both for medicines and attendance. Parishes, supported by landowners and other random local sources of funding, provided relief to the poor in the form of food, clothing, or money much of it below the level of subsistence and offered limited medical or surgical expenses. The "New" Poor Law in Scotland The Poor Law (Scotland) Act 1845 brought in tow major developments which changed the public face of the Poor Law in Scotland: o The establishment of a central Board of Supervision which was given the power to raise local taxed for the relief of the poor. o The transfer of responsibility for the registered poor from the Church of Scotland to Parochial Boards, which came under the authority of the newly established Board. o The Board of Supervision had centralised control. At a local level considerable power was vested in the parochial boards which had the power to raise poor funds by assessment, which then became an annual charge. In Scotland, outdoor relief was more common and poorhouses less so than in England. Record Types. Parish records are held by local authority archives and some by the National Records of Scotland: Midlothian (CO2/77-91); Wigtownshire (CO 4/30-47)); East Lothian (C07/7, DC 5/4-5 and DC 7/4) Survival of the other parish records is patchy.

Other Poor Law records include: Kirk session minutes Heritors minutes Parochial Board records Poor rolls Registers Accounts Parliamentary papers. Scottish Poor Law web site by professional genealogist Kirsty Wilkinson files/records of the Scottish Poor.pdf.
