2 PRESIDENT'S MESSAGE At the last meeting of the Board of Directors of the Missouri State Genealogical Association, Inc., the bylaws of the Association were changed, and 'control of the Association turned over to the membership. Directors will now serve two year te~s and will be elected to specific positions on the Board of Directors. The membership will elect the president, vice president, etc. Half of the directors will be elected one year and the other half elected the following year, thus h~ing experienced persons on the board at all times. There will be a transition period which will be somewhat awkward, but with the good will of the members of the board and working with the membership for the good of the Association, it should go smoothly. After August 3, 1985, the membership will be notified of any proposed bylaw changes, as well as being sent a ballot containing the names of the proposed officers with a short biographical sketch of each. The success of this organization will now rest in the hands of the members. Your help in notifying the nominating committee chai~an of a person having the time and ability to serve the organization will be appreciated. If you will send the persons name, address, telephone number and a short biographical sketch to the nominating committee chairman, they will be given due consideration. We are still working on the plans to implement these changes, finalizing the bylaws with the minor revisions made before the final voting was done, and organizing the standing rules needed to make this a workable set of by laws. This information will be made available to the members as soon as is pracbible, There will be a number of committees needing help and a number of offices to be filled next year. Your participation, either as an officer, or on a working committee, will assure the success of this organization. Having served this association in a number of positions since 19?9, first as vice president, treasurer pro-tem, editorial director, and now as President I can assure you there is a place for anyone who wants to help. My grandmother had two favorite sayings.. "many hands make light work"..and "idle hands are the devil's workshop". They are as true today as they were so many years ago. The Missouri State Archives is expanding their hours to help those researchers who are working five day weeks. If you have some time and would and could help..please write or call them and let them know you are available. Help is also needed on the records currently being microfilmed, both in the counties, arranging the records for microfilming, and in the Archives.

3 EDITOR'S MESSAGE One of my duties as Editor is to retype and sometimes edit queries that members submit. Some are well written and need no editing. Others are practically illegible and need considerable revising. Help is on the way for those who feel they need help in writing queries. I have developed a query form which is printed at the end of this issue. Simply fill in the blanks and mail it to the association. Feel free to make photocopies of this form and submit as many queries as you want. I am not asking that everyone use ~his form; only those that need it. We will continue to accept queries that are written freehand. The value of submitting queries is frequently underestimated. Current members of the association are not the only people who have the opportunity to read our queries. The Journal is exchanged with a number of other statewide genealogical societies. By placing a query in the Journal a member of our association can make a permanent record of his research efforts and have this information preserved in a number of different libraries. One of the benefits of being a member of MoSGA is that you are entitled to submit an unlimited number of queries for publication in the Journal. Please take advantage of this service. The Journal will become a better periodical and your research activities will become more publicized '\! (' f u.:,j ~.J ~,rta-fa/~ MISSOURI STATE ARCHIVES TO EXPAND HOURS Roy Blunt, Secretary of State and Missouri's Chief Archivist, has announced that on May 4, the State ArChives, 1001 Industrial Drive, Jefferson City, will be open on Saturdays. He explained that in the past, only professional researchers had access to the archives because of the lack of week end hours. Preliminary Saturday hours are 8:30 a.m. to 3:30 p.m. throughout the remainder of the summer. The Archives will be closed Memorial Day weekend and Labor Day Weekend. Visitors will be able to utilize the center's complete microfilm library as well as the entire library of research books. Actual historical documents will not be available on Saturdays except by prior arrangement due to security and staffing levels. This project is being undertaken through a combined effort of the archives' staff and local researchers at no additional cost to the state. Members of local historical groups and genealogical societies are volunteering their Saturdays and will work with members of the archives' staff who are working flexible work-weeks to provide the extra hours of operation. Blunt said the levels and types of usage during this pilot project will be carefully monitored and will be used to evaluate the potential for continuing the additional hours on a permanent basis and to determine if there is a de:- mand for evening hours during the week. Negotiations are also under way to increase the outreach of the archives. A volunteer support group may provide traveling exhibits of historical documents and facsimiles on a limited basis. 5 MoSGA JOURNAL~ Bummer GUIDE TO PUBLIC VITAL STATISTICS IN MISSOURI BIRTH RECORDS Prepared by the Missouri Historical Records Survey, Division of Community Service Programs, Works Projects Administration~ Published St. Louis, Mo., The Missouri Historical Records Survey, July Early Legislation The first provision for the registration of births in Missouri was made in This was not a compulsory registration law but provided that the recorder keep a record of births in the same manner as deeds were recorded. These entries were to be made upon request and there was no requirement that parents or professional attendants send in the information for recording. This law is still in effect and offers the only means of recording in Missouri the births of persons born outside of the State after August 16, Prior to the termination of the Civil War, some negroes who were held in slavery lived together as husband and wife without having been legally married. When they were emancipated, a provision was made for their marriage and for the recognition of the legitimacy of all children born to them before their mar» riage. This law made them liable to original prosecution if they continued to cohabit without being married, but it did not compel them to record the names of their children. The officer performing the marriage ceremony, usually the justice of the peace of the township in which the parties resided, was obliged to transmit to the recorder of the county a certificate of the marriage, together with the names, as given to him, of the living children and the descendants of any deceased children. The recorder was required to record those certificates within one month after receiving them.2 These colored marriage records are also, in effect, a record of births as shown in the abstracts of a Washington County record as follows: "This is to certify that I have solemnized the rites of marriage between Darby Modistead to Eliza Martin (Persons of color who have heretofore cohabited togather as husband and wife while held as Slaves) in Washington County Mo. on the 6th day of October 1865 and I further certify that the names of the Children of the said Darby & Eliza as they gave them to me at the time of their marriage aforesaid are as follows to-wit; Dalico Benjamin Matilda Lucy Albert Medora Emily Luvena Given under my hand this of the Gospel. Filed Oct. aged " 36 " " 28 " " 24 " 23 " ) " 23 " ) " 18 " " 16 " 40 years 11th day of October Philip Langford, Minister 11th Wm. T. Hunter, Recorder." The first compulsory registration of births in the State was started on July 12, 1870 in the City of St. Louis, and was applicable only to births occurring within the city.l This registration was continued by the city until 1910 when the present State-wide system went into effect, and the registration of births occurring in the city was made subject to the state law. 6 122 MoSGA JOURNAL~ Summer 1985 to 1910 has been reliably estimated as having been only about 60 percent complete, due principally to negligence on the part of persons charged w.ith the duty of reporting the births. First State-Wide Registration The first provision for the compulsory State-wide registration of births was enacted on July 1, 1883, when the State Board of Health was created and charged with the supervision of such registration. The secretary of the board was designated as the superintendent of registration~2 To insure a complete and thorough registration, standardized forms were to be furnished by the secretary to all county clerks, who were made registration officers in their respective counties. 3 Any physician or other professional attendant failing to report any birth under his supervision to the county clerk within 30 days was subject to a $10. fine for each offense. If no professional attendant was present at a birth the parent was obliged to report the occurrence to the county clerk within the same time limit and under penalty of the same fine.4 The births so registered were transcribed by the county clerk into a permanent record book within 10 days after December 31 of each year. A complete report of all such registrations was then forwarded to the secretary of the State Board of Health.5 Records were kept by county officers in accordance with the above law until 1893 when the entire law concerging registration of births was repealed and compulsory registration ceased.. Present System Inaugurated The present system of registering births became effective on August 16, 1909, as a function of the State Board of Health. It became the duty of the board to prepare the necessary methods and blanks for obtaining and preserving such records and to insure the faithful registration of the same in the registration districts and in the central bureau of vital statistics at the State Capital. A bureau of vital statistics was established by the board and placed under the direct supervision of the secretary of the board. Thesecretary was designated as the State Registrar of Vital Statistics. To insure the completeness of registration, the State was divided into registration districts. Each city and incorporated town constituted a primary registration district and the remaining portion of each county was divided into rural registration districts. l An amendment to this law, effective July 1,1937, provides that all counties having a population of two hundred thousand and less than four hundred thousand shall constitute a primary registration district.2 Where a deputy state health commissioner shall have been appointed by the county court, said deputy shall 4 be the local registrar.3 Only St. Louis County was affected by this amendment. The Act of 1909 provided for the appointment by the State Board of Health of a local registrar for each registration district. Ther term of office of such appointee being four years. The health officers or other officials who had conducted effective registration of births under local ordinance continued as registrars. These officials were subject to the rules and regulations of the State Registrar and to the provisions of the act. Each local registrar was to appoint a deputy to act in his stead in case of abscence, illness, or disability. The local registrar also had the privilege of appointing, with the approval of the State Registrar, one or more sub-registrars when it became necessary for the convenience of the people in his registration district. The sub-registrar was subject to the supervision and control of the State Registrar.5

7 MoSGA JOURNAL~ Sumner The law provides that every birth occurring.. ~ the State shall.be immediately registered in the district in which it occurrs. Wi.thiriten days.af'ter the date of birth the attending physician or midwife must file With the local registrar of the district a birth certificate properly and completely filled out. If there is no attending physician or midwife it is the duty of the father or mother of the child, householder or owner of the premises, manager or superintendent of public or private institutions in which the birth occurred, to notify the local registrar within ten days after the occurrence. It shall then be the duty of the local registrar to secure the necessary information and signature to make a certificate of birth.7 All superintendents or managers, or other persons in charge of hospitals, almshouses, lying-in or or other institutions, public or private, to which persons resort for treatment or confinement, are required to make a record of all the personal and statistical particulars as set forth in the certificate of birth.8 It is the duty of the local registrars to supply blank forms of certificates to such persons as require them. Each certificate of birth must be carefully examined when presented to the local registrar for record, and if it is incomplete he immediately notifies the informant and requires him to supply the missing items if they can be obtained. The certificates are then numbered beginning with the number "one" for the first birth in each calendar year, and signed by the local registrar in attest of the date filed in his office. The local registrar also makes a complete and accurate copy of each birth certificate registered by him in a record book of approved form to be kept and permanently preserved in his office as the local record of such birth. On the tenth day of each month, he transmits to the State Registrar all original certificates registered by him during the preceeding month. If a month passes without a birth being recorded in his districts he reports that fact to the State Registrar on a card provided for this purpose. l The local registrar is charged with the strict and thorough enforcement of the provisions of this act in his district, under the supervision and direction of the State Registrar. He makes immediate report to the State Registrar of any violation of this law coming to his notice by observation or upon complaint of any person, or otherwise. 2 Each local registrar is entitled to be paid the sum of 25 cents for each birth certificate properly and completely made out and registered with him and correctly copied and duly returned by him to the State Registrar. He also receives 25 cents for each monthly report of no births. These fees are paid by the county in which the registration district is located upon certification by the State Registrar to the county treasurer. 3 Every physician or midwife must register his or her name with the local registrar of the district in which he or she resides, and a copy of this register is sent to the State Registrar within thirty days after the close of each calendar year. Any physician, midwife, or other person charged with the responsibility of reporting a birth who neglects or refuses to file a proper certificate of birth within the required time is subject to a fine of not less than $5. nor more than $50. A local registrar who neglects his duties is subject to a fine of not less than $10 nor more than $100. Any person found guilty of wilfully altering a birth certificate or a copy on file in the office of a local registrar is subject to a fine of $10 to $100, or imprisonment in the county jail for sixty days, or to be fined and imprisoned at the discretion of the courts.5 Birth Certificates

8 124 MoSGA JOURNAL., SWTTmer 1985 Revised forms of birth, and stillbirth certificates as recommended by U.S.,Bureau of the Census were adopted and distributed during The new certificate forms were adopted in this State in order to maintain compatability as to form and statistical data with other state health departments, and because they were considered an improvement over previous forms.' This standard certificate of live births shows information as follows: 1. Place of birth (including name of hospital or institution, if any). 2. Usual residence of mother. 3. Full name of child. 4. Date of birth. 5. Sex of child. 6. Whether single or plural birth. 7. Number of months of pregnancy. 8. Is mother married. 9. Full name of father. 10. Color or race of father. 11. Age of father. 12. Birthplace of father. 13. Usual occupation of father. 14. Industry or business of father. 15. Full maiden name of mother. 16. Color or race of mother. 17. Age of mother. 18. Birthplace of mother. 19. Usual occupation of mother. 20. Industry or business of mother. 21. Number of other children born to mother. 22. Mother's mailing address for registration notice. 23. Attendant's certificate showing hour of birth, attendant's signature, and address. 24. Date of filing with local registrar. 25. Registrant's signature. 26. Date given name was added (if not at time of original registration.)2 Stillbirths The following definitions have been published by the State Board of Health to differentiate between live births and stillbirths. Births. A birth is deemed complete at the instant when the whole of the body of the foetus, head, trunk, and limbs, is outside of the body of the mother. Live Birth. The birth is deemed to be a live birth if, after the birth (as defined) the infant breathes. Stillbirths. A stillbirth is a birth of a foetus (as defined) in which pulmonary respiration does not occurr, such a foetus may die either (a) before, (b) during, or (c) after birth, but not before it has breathed. l In cases of stillbirths a certificate is registered showing information identical to items 1 to 21 of the live-birth certificate and in addition details of the cause of stillbirth, a statement by the embalmer, and details of the disposition of the body. Stillborn children are registered as births and also as deaths. The certificate of birth contains the word: "Stillbirth" in place of the name of the child. 2 Adoptions and Legitimizations In adoption cases a new certificate is set up showing the principal details of

9 MoSGA JOURNAL~ Sumner the original birth certificate and recording them as that of a natural child of the foster parents. In legitimization cases a new record is set up showing the child as being born in wedlock. While the last two procedures const ft.utes an alteration of a public record, the untold benefits derived from doing so makes a very desirable s.ystem. Duties of State Registrar The State Registrar is charged with the thorough and efficient execution of all the provisions of the laws pertaining to the registration of births in e- very part of the State. He has supervisory powers over all local registrars. He has authority to investigate cases of irregularity or violation of the law, personally. or by accredited representatives, and all registrars must aid him upon request. When he deems it necessary he must report cases of violation of the law to the prosecuting attorney of the proper county or municipality, and the prosecuting attorney must initiate the necessary court proceedings against the offending party. The Attorney-General of Missouri must assist in the enforcement of this law when requested to do so by the State Registrar.3 The State Registrar must supply the local registrars with all forms necessary to properly register all deaths and births, and no other blanks may be used than those supplied by him. When these blanks have been filled in and returned to the State Registrar it is his duty to carefully examine the certificates and to secure additional information if they are incomplete or in any way unsatisfactory. All physicians, midwives, informants, or undertakers connected with any case, and all other persons having knowledge of the facts are obliged to furnish such information as they may possess regarding any birth upon demand of the State Registrar in person, by mail, or through the local registrar. The State Registrar must permanently preserve the birth certificates in a systematic manner, and shall maintain a comphrehensive and continuous card index of all births registered. l All births recorded at Jefferson City under. the preregistration system are well indexed. This work was done by the Works Projects Administration and reduced the possible location of a birth record to just one place. The soundex system is used.2 Local Registration The local registration districts in the State, as originally determined in 1910, have remained practically unchanged. As a result most counties have too many registrars whose compensation is small. By combining those districts and placing registrars in trade areas where physicians and undertakers are located, better compensation for the registrar would result and a corresponding improvement in the quality of their work could be expected. A plan of appointing a single county registrar instead of the several local registrars is now being tried, but it is still in the experimental stage. This plan is being tried in Adair, Butler, Douglas, Knox, Lewis, Madison, St. Louis, and Shannon counties. Further extension of this plan awaits positive proof of its effectiveness.3 Birth registrations under the present system are not complete. Parents are often unaware of the need of birth registration and of their responsibility in insisting that an attendant report the birth promptly. Attending physicians have been permitted to ignore the law for so many years that some of them feel that birth reporting is no longer necessary. Unlicensed midwives, or "grannies" have frequently failed to report for fear of prosecution by the health department. A supervisor of midwifery in the Division of Child Hygiene of the State Health Department in making a survey, found a "granny" who had delivered

10 126 MoSGA JOURNAL, Summer 1985 more than four hundred mothers and who had never reported a single birth. A test of birth registration was made in 1934 through the cooperation of the United States Bureau of the Census, the United States Post Office, the Federal Emergency Relief Administration, and the Missouri State Health Department. Franked post cards were placed in every mail box in the State,. asking for the name of any child born in the previous 12 months. The cards were returned to the State Health Department where they were checked against certificates on file. The total number of cards distributed is not known, but 26,945 cards were returned. Those returned from the larger cities, namely: Joplin, Kansas City, Moberly, St. Joseph, St. Louis, Sedalia, and Springfield, were not included in the above number nor were they checked because registration in those centers is more complete and the labor involved would have been too great. Of the 26,945 cards returned, 3,506, or 13 percent were not registered. It is estimated that this percentage would have been about 10 percent if the cities had not been included in the test. The maximum percentage permitted for admission to the United States Birth Registration Area is 10 percent. As a result of this test it was disclosed that birth registrations throughout the State were only about 87 percent complete. Of the 114 counties (not including St. Louis City, only 28, or 25 percent, showed 90 percent complete registration or better, 53 counties, or 47 percent, showed 87 percent to 90 percent, and 34 counties, or 30 percent, were below 80 percent of complete registration. The lowest percentage was 43.1 in New Madrid County and the highest was 97.9 percent in Lincoln County.l State Registration In 1931 provision was made to establish a public record for persons born prior to the effective date of the present registration system. All persons born in the State and all residents born elsewhere prior to August 16, 1909, were then permitted to file proofs with the State Registrar at Jefferson City. Blank registration forms are provided for this purpose and it is generally considered sufficient if affidavits of two persons familiar with the facts are filed as proof. However, the acceptance for registration of affidavits and other documentary does not constitute proof but only certifies to the fact that such evidence has been filed. The State Registrar endeavors to establish the truth of the statements presented for recording when there is any doubt as th their authenticity. A certified copy of these records shows proof submitted but does not guarantee their accuracy. A registration fee of $2.50 is required for this service but there is a bill pending (July 1941) to reduce it to $1.00. Certified Copies There is no specific provlslon for executing a certified copy of a birth registration made with the recorders under the 1863 law or with the county clerks under the 1883 law. However, under a law providing for the issuance of copies of public records, a certified copy of these old birth records may be secured from the official in charge at a cost of 10 cents for every 100 words and 50 cents for certification. 3 A certified copy of the record of any birth registered in Missouri since January 1, 1910, can be obtained from the State Registrar of Vital Statistics at Jefferson City, Missouri, upon the payment of a 50 cent fee. Certified copies required to perfect the claim of any person on relief are furnished free. A certified copy of a birth registration made since January 1, 1910, when properly certified by the State R gistrar is prima facie evidence in all courts of all the facts stated herein. 4 Certified copies of birth

11 MoSCA JOURNAL~ Summer registration made under the provisions of the 1931 law of persons born ~rior to January 1, 1910, are furnished by the State Registrar at 50 cents each. In the City of St. Louis, the Registrar of Vital Statistics, located at No. 10 Municipal Courts Building, makes copies of any record in his office. A non certified transcript of any of these records may be had for a fee of 25 cents each. A certified copy of the St. Louis records from 1870 to 1910 may be had for $1.00 each. l These certified copies are prima facie evidence in any court as they are copies of the health commissioner's records and are certified by the health commissioner. 2 As a matter of convenience to the residents of St. Louis, who number approximately one-fourth of the entire State population, an arrangement has been made to furnish certified copies of registration made since 1910 at 50 cents each. These certified copies serve most of the ordinary purposes for which copies are issued but they are not prima facie evidence in any court because they do not bear the signature of the State Registrar and are issued without any statutory authority, but with the consent of the State Registrar.3...For the benefit of those persons whose birth was not registered and who therefore are unable to secure a certified copy of birth registration, the following abstracts of the Missouri Statutes may prove va.luab.le: "When, by the ordinance or custom of any religious society or congregation in this State, a register is req~ired to be kept of marriages, pirths~ baptisms, deaths, or interments, such register shall be admitted as evidence".4 "Copy of record of births kept by a religious society, verified by the oath of the keeper of such record, is a competent evidence to prove age".5 "When a church register is kept in a foreign country in accordance with the rules and customs of such country and proven to be admissible in evidence in the country where kept, copies of such register, authenticated by the deposition of the custodian thereof~ arg admissible to prove the age of a party where baptism is therein recorded". "Copies of the register referred to in the preceding section, certified by the pastor or other head of any such society or congregation, or by the clerk or other keeper of such register, and verified by his affidavit in writing, shall be received as evidence".7 Record Inventory The following inventory of birth records located in each county are mostly those kept by the county clerks. As previously stated there was no law providing for the keeping of these records prior to 1883 or after Where the records show starting dates before 1863 or terminal dates after 1893 it is presumed that they were kept for those periods on the initiative of the county clerks. Present facilities and lack of time do not permit a recheck of these records to verify this assumption. "The present inventory includes the file of State birth registration records maintained by the State Registrar of Vital Statistics in Jefferson City since August 16, 1909, and all extant earlier county and local records. In addition there are included local birth registration records postdating August 16, 1909, for certain localities, such as Kansas City, New Madrid, St. Louis City, and St. Louis County, where special series of birth registrations. have been maintained. Records in the hands of the approximately 1200 local registrars have not been included as they but duplicated the central State records in Jefferson City." 24 140 MoSGA JOURNAL 3 Summer 1985 Burton as to his children etc. in a suit against his son-in-law Gabriel Maupin concerning the disposal-by Maupin of Burton's estate and slaves when they left Virginia for MO. This file is in WESTERN HISTORICAL MANUSCRIPTS COLLECTION - Ellis Library, University of Missouri, Columbia, MO. This document is not dated but the last date is November 1836 that is mentioned in body of document. It is on legal size paper and 10 pages long. The following is very briefly abstracted: "To the Circuit Court of County of Randolph. Your orator William Burton, says that in the year 1828 he resided in Orange Co., VA possessed of a considerable estate, consisting of about 400 acres of land, nine slaves, horses, cattle, sheep, hogs, farming utensils, household & kitchen furniture, crops of corn, wheat, tobacco, & other vegetable produce, other personal property worth at least two thousand dollars. He said that he had seven children. Abram then settled in the state of Kentucky; Robert then settled in the state of Tenn.; Nancy Blackwell then settled in the state of Virginia; Lucinda Hall then married and settled in Kentucky; Betsy Blackwell married but then still residing with your orator; Virginia Maupin then married and settled in Virginia; Permelia Burton then living with your orator. All his children except his youngest Permelia were settled in life and he had given to each of them except Betsy Blackwell, Virginia Maupin & Permelia a slave or land equivalent in value. He intended that slave Polly was for his dau. Betsy, slave Harriet for his dau. Lucinda and slave Sarah for dau Parmelia. Your Orator states that he was at that time about 73 years old and the mother of his children about 66 years old. In 1828 he employed Gabriel'Maupin who had intermarried with his dau Virginia to reside and superintend and manage his affairs. The said Gabriel Maupin came to the resolution of removing the family to the state of Mo. and persuaded and induced your orator to dispose of his property.
