District Profile and Fund Balances Community Facilities District No Series 2011 Special Tax Refunding Bonds Location The District is located in the City of Murrieta, in southwestern Riverside County near the intersection of Interstate 15 and Interstate 215, approximately 30 miles south of the City of Corona and 5 miles north of the City of Temecula. The CFD contains over 2,100 acres which have been developed as principally residential in nature, and which have primarily been improved with single family homes and commercial development including a regional shopping center. Project Description The District was originally formed to finance the construction of water transmission lines and storage tanks, sewer lines, and to pay costs of annexing the Water District to the Metropolitan Water District. The District s bonds were refunded under Western Municipal Water District and additional bonds were issued to finance part of the cost of improvements and modifications to the water supply and distribution system of the Water District serving CFD 88-1, including the repair of wells proximate to CFD Bond Profile and Principal Amount of Bonds Outstanding The Community Facilities District No of Western Municipal Water District Series 2011, Special Tax Bonds (the Bonds ) refunded the outstanding Series 1996 and 2000 Special Tax Bonds, previously issued by Murrieta County Water District. The Bonds were issued September 29, 2011 in the principal amount of $3,630,000, with interest rates ranging from 1.125% to 5.250%. Interest on the Bonds is payable semi-annually on April 1 and October 1. The final maturity of the Bonds is October 1, In April 2016, Bonds were called in the amount of $80,000 due to surplus funds. The principal amount of Bonds outstanding as of June 30, 2017 was $2,120,000. Fund Information The Fund Balances of the bonds as of June 30, 2017 are in Table 1-1 shown below. Transfers are then made from the Special Tax Fund to the Interest Account on or before each Interest Payment Date, April 1 and October 1, so that the balance in the Interest Account is equal to the amount of interest becoming due and payable on the Bonds on such date. Transfers are then made from the Special Tax Fund to the Principal Account on or before the Principal Payment Date on October 1, so that the balance in the Principal Account is equal to the principal amount of the Bonds required to be redeemed on such date. On the first Business Day following each Interest Payment Date, moneys remaining on deposit in the Interest and Principal Accounts shall be transferred to the Special Tax Fund. District Profile and Fund Balances Reserve Fund The Reserve Fund must be maintained at the Reserve Requirement which is defined as that amount as of any date of calculation the lesser of (i) ten percent (10%) of the initial principal amount of the Bonds, (ii) Maximum Annual Debt Service on the Outstanding 88-1 Bonds, or (iii) one hundred twenty-five percent (125%) of the average Annual Debt Service on the Outstanding 88-1 Bonds. Any money in the Reserve Fund will be used and withdrawn by the 88-1 Fiscal Agent for the purpose of paying the interest on or principal of the 88-1 Bonds in the event there is insufficient money in the Interest and Principal Accounts available for this purpose, or in the event the 88-1 Special Tax on a parcel is prepaid pursuant to the 88-1 Fiscal Agent Agreement. The Reserve Fund will then be replenished by increasing the next year s special tax levy to the extent permitted by law. The balance in the Reserve Fund as of June 30, 2017 was $277,070.54, and the Reserve Requirement was $251, Annual Report for Fiscal Year ending June 30, 2017 Western Municipal Water District Community Facilities District No
5 2. Special Taxes and Owner Information Special Tax A special tax is collected each year to pay the principal and interest obligations on the Bonds of the District. The amount collected each year is determined by the special tax formula and can vary from year to year, but shall not exceed the maximum authorized (or permitted) special tax rates. The amount levied for the tax year was $416, The assigned special tax rates for the tax year are in the tables below. Foreclosure Covenant Pursuant to Section of the Act, the Water District, in the event any Special Tax or installment thereof or any interest thereon is not paid when due, the Water District may order the institution of a Superior Court action to foreclose the lien therefore. In such an action, the real property subject to the unpaid amount may be sold at judicial foreclosure sale. This foreclosure sale procedure is not mandatory under the Act. Under the Fiscal Agent Agreement the Water District will on or about July 15 of each Fiscal Year, compare the amount of Special Taxes theretofore levied in CFD 88-1 to the amount of 88-1 Special Tax Revenues theretofore received by the Water District, and; Individual Delinquencies. If the Water District determines that any single parcel subject to the 88-1 Special Tax in CFD 88-1 is delinquent in the payment of Special Taxes in the aggregate amount of $2,500 or more, then the Water District shall send or cause to be sent a notice of delinquency (and a demand for immediate payment thereof) to the property owner within 45 days of such determination, and (if the delinquency remains uncured) foreclosure proceedings shall be commenced by the Water District within 90 days of such determination to the extent permissible under the County s Teeter Plan program and applicable law. Aggregate Delinquencies. If the Water District determines that (i) the total amount of delinquent Special Tax for the prior Fiscal Year for CFD 88-1, (including the total of individual delinquencies above), exceeds 5% of the total 88-1 Special tax due and payable for the prior Fiscal Year, or (ii)) there are ten (10) or fewer owners of real property within CFD 88-1, determined by reference to the latest available secured property tax roll of the County or other official records of the County, then the Water District shall notify or cause to be notified property owners who are then delinquent in the payment of Special Taxes (and demand immediate payment of the delinquency) within 45 days of such determination, and shall commence foreclosure proceedings within 90 days of such determination against each parcel of land in CFD 88-1 with a Special Tax delinquency. 7 4. Senate Bill 165 Community Facilities District No Series 2011 Special Tax Bonds Senate Bill 165 shall be cited as the Local Agency Special Tax and Bond Accountability Act. This Act requires that any local special tax/local bond measure subject to voter approval contain a statement indicating the specific purposes of the special tax, require that the proceeds of the special tax be applied to those purposes, require the creation of an account into which the proceeds shall be deposited, and require an annual report containing specified information concerning the use of the proceeds. The Act only applies to bonds issued on or after January 1, 2001 in accordance with Sections and of the California Government Code. Some of the requirements of the Act are handled at the formation (bond issuance) of the Special Tax District and others are handled through annual reports. This section of the report intends to comply with Sections and of the California Government Code that states. The chief fiscal officer of the issuing local agency shall file a report with its governing body no later than January 1, after the bonds have been issued and at least once a year thereafter.
