Moreover, the promotion of improved scientific advice on the status of the main stocks in the Black Sea and on the fisheries exploiting these stocks is of outmost importance for the implementation of the Common Fisheries Policy in this particular region. The scientific basis of these plans and on the status of the different stocks shall come from analysis carried out by scientists of EU Member States both at EU and national level as well as within the Scientific Advisory Committee of the General Fisheries Commission for the Mediterranean (GFCM-SAC). With a view to further support the scientific community in the Mediterranean and in the Black Sea, the Commission has given mandate to its Scientific, Technical and Economic Committee for Fisheries (STECF) to adopt an operational work-programme in order to update the knowledge on the status of the exploited demersal and small pelagic stocks. One of the main tasks within this work programme is to evaluate the exploitation levels with respect to their biological and economic production potentials and the sustainability of the exploited stocks. It is intended to achieve this task by using both trawl and echo surveys as well as commercial landings/discards and fishing effort data as collected through the Community Data Collection programme (Council Commission européenne/europese Commissie, 1049 Bruxelles/Brussel, BELGIQUE/BELGIË - Tel

2 Regulation (EC) 143/2000) and the Community Framework for data collection (Council Regulation (EC) 199/2008) as well as other suitable scientific information collected at national level through national and community funded studies and research projects. (See specific mandate to STECF in ANNEX 2). This will enhance the capability of EU scientists to provide the scientific basis for sustainable fisheries management both at EU and GFCM level. Since the launching of STECF activities in 2008, seventeen expert meetings have already taken place, which have contributed to further analyze the available information and provided light on the biological state of the main Mediterranean and Black Sea stocks. In the forthcoming 2012-STECF expert working groups' meetings scientists from all EU Mediterranean and Black Sea countries are expected to continue carrying out joint assessments, using different methods and data sources, on several stocks of important demersal and small pelagic species including, in particular, hake, red mullets, deep water rose shrimp, red shrimp, blue and red shrimp, Norway lobster, picarei, sardine, turbot, sprat, and anchovy. However, the full list of species for which STECF is expected to carry out assessments and whose data must be uploaded is provided in ANNEX 1, Appendix 7. Following a similar approach as that implemented in previous years, the Commission herewith asks Member States to provide data to the Commission, as soon as possible and not later than 18 June 2012, for the STECF-EWG 12-0 and Mediterranean meetings planned to be held during the weeks of 16 July 2012 and 10 December 2012 respectively. A subsequent uploading of 2012 surveys data is expected to be done by 3 December 2012 (see below) 14 September 2012 for STECF-EWG Black Sea meeting, planned to be held during the week of 8 October Data have to respect the format in ANNEX 1. The lists of scientists that, after individual registration, will be invited to attend the EWG meetings will be made available on the STECF web-site in due time in advance of the meeting. Whenever considered advisable, and according to each national scientific coordination system, the invited scientists are expected to have with them the equivalent data sets, by GFCM- concerned, just to overcome possible technical problems of data uploading by Member States. Any use of data different from those uploaded by MS will be duly justified and recorded in the STECF EWG report. These data are requested in full for the periods (catches, landings, discards and fishing effort data), (MEDĪTS) and the complete time series for the annual scientific surveys other than MEDĪTS. The need of a complete resubmission derives from some incomplete and inconsistent submissions in and also to allow for submission of revised series. An overview of data submitted and missing in the data call of 2011, using 1 December 2011 as time limit for the call (late submission are considered missing), is reported in Table 1 in ANNEX 3. In Table 2 (ANNEX 3) are summarized the stocks assessed by STECF over the period and highlights the areas and species in need of assessment. Member States are invited to upload the data onto the JRC server at https//datacollection.jrc.ec.europa.eu/ where details on the required parameters and aggregation levels are available as well. The Commission reminds Member States that according to Article 8(4) and 8() of Regulation (EC) No 199/2008, reductions and suspensions of European Union financial assistance may be applied by the Commission in case of lack of data transmission by the Member States to regional

3 RFMO and scientific bodies. Therefore the Member States are encouraged to respect the above mentioned deadline and to provide all requested data. Member States shall take note of the new Data Validation Tool (provided by DG-JRC and downloadable from https//datacollection.jrc.ec.europa.eu/web/dcf/dc/medbs and are encouraged to use it out in order to support the data submissions and enhance the data quality. Member States, that had foreseen in their DCF National Programmes to deliver, sometime in 2013, the data corresponding to the 2012 MEDĪTS and echo-surveys are specifically invited to submit those data in advance and in any case before Just to overcome possible technical problems of data uploading by Member States, the invited scientists are expected to bring with them the equivalent 2012 data sets by GFCM- concerned and that, according to each national scientific coordination system, are authorized to use them. Member states are requested to provide information collected under Commission Regulation No 1639/2001 as amended by Regulation No 181/2004, Commission Regulation No 66/2008, Commission Decision 2008/949/EC and Commission Decision 2010/93/EU. In addition we invite Member States to authorize the scientists to make use of all the necessary data as collected in research projects funded at national level only. In this context, we remind Member states their obligations under Article 4(3) of the Treaty of the European Union. We expect that scientists, in order to complement what is collected under the Data Collection Community Programme, will make use of all data collected through the research projects and studies funded by the European Community. 33 ANNEX 2 Mandate to the STECF for the SubGroup on Mediterranean The European Community is expected to establish long-term management plans (LTMP) for relevant Mediterranean demersal and small pelagic fisheries based on precautionary approach and adaptive management in taking measures designed to protect and conserve living aquatic resources, to provide for their sustainable exploitation and to minimise the impact of fishing activities on marine eco-systems. The plans shall include conservation reference points such as targets against which measuring the recovery to or the maintenance of stocks within safe biological limits for fisheries exploiting stocks at/or within safe biological limits (e.g. population size and/or long-term yields and/or fishing mortality rate and/or stability of catches). The management plans shall be drawn up on the basis of the precautionary approach to fisheries management and take account of limit reference points as identified by scientists. The quantitative scientific assessment should provide sufficiently precise and accurate biological and economic indicators and reference points to allow also for an adaptive management of fisheries. Stating clearly how stocks and fisheries will be assessed and how decision will be taken is fundamental for proper and effective implementation of management plans as well as for transparency and consultations with stakeholders. Demersal and small pelagic stocks and fisheries in the Mediterranean are evaluated both at national and GFCM level; however these evaluations are often not recurring, are spatially restricted to only some GFCM geographical sub-areas (see attached reference map), covering only partially the overall spatial range where Community fishing fleets and stocks are distributed, and address only few stocks out of several that may be exploited in the same fisheries. Limited attention is also given to technical interactions between different fishing gears exploiting the same stocks. A limited, although fundamental, scientific contribution of EU fishery scientists to the GFCM assessment process is increasingly affecting the capacity of this regional fisheries management organization to identify harvesting strategies and control rales and to adopt precautionary and adaptive fisheries management measures based on scientific advice. Anyhow, GFCM and most of the riparian countries consider that management measures to control the exploitation rate and fishing effort, complemented by technical measures, are the most adequate approach for multi-species and multiple-gears Mediterranean fisheries. Nevertheless, provided that scientific advice underlines to do so, also output measures may be conceivable to manage fisheries particularly for both small pelagic and benthic fish stocks. Coherence and certain level of harmonization between Community and multilateral framework measures are advisable for effective conservation measures and to enhance responsible management supported by all concerned Parties and stakeholders in the Mediterranean. STECF can play an important role in focusing greater contributions of European scientists towards stocks and fisheries assessment, in identifying a common scientific framework

34 regarding specific analyses to advise on Community plans and to be then channeled into or completed by the GFCM working groups 1. STECF was requested at its November plenary session to set up an operational workprogramme for 2008, beginning in the 1 st quarter of 2008, with a view to update the status of the main demersal stocks and evaluate the exploitation levels with respect to their biological and economic production potentials and the sustainability of the stock by using both trawl surveys and commercial catch/landing data as collected through the Community Data Collection regulation 143/2000 as well as other scientific information collected at national level. Within this work-programme STECF is also requested to provide its advice on the status of the main small pelagic stocks and to evaluate the exploitation levels with respect to their biological and economic production potentials and the sustainability of the stock by using both echo and/or DEPM surveys and commercial catch/landing data as collected through the Community Data Collection regulation 143/2000 as well as other scientific information collected at national level. STECF should take into consideration the data that Member States have been collecting on a regular basis both via monitoring fishing activities and carrying out direct surveys. STECF, in replying at the following terms of reference, should also take into consideration chapter 7 of the 26 th STECF Plenary session of -9 November , as well as the report of the STECF working group on balance between fishing capacity and fishing opportunities. STECF shall contribute to identify and setup a advisory framework regarding low risk adaptive management by identifying and using appropriate risk assessment methods in order to understand where we stand with respect to sustainable exploitation of ecologically and economically important stocks and what additional management actions need to be taken. On the basis of the STECF advice the Commission will launch official data calls to EU Member States requesting submission of data collected under the Community Data Collection regulation 143/2000. The selected assessment methods shall allow estimating indicators for measuring the current status of demersal and small pelagic fisheries and stocks, the sustainability of the exploitation and to measure progress towards higher fishing productivity (MS or other proxy) with respect to precautionary technical/biological reference points relating to MS or other yield-based reference points, to low risk of stock collapse and to maintaining the reproductive capacity of the stocks; - to set up a conceptual, methodological and operational assessment framework which will allow STECF to identify economic indicators and reference points compatible with economic profitability of the main fisheries while ensuring sustainable exploitation of the stocks in the Mediterranean; to indicate whether age/length-based VPA or statistical catch-at -age/length methods are adequate modelling tools to estimate precautionary indicators and reference points measuring the current status and future development of multispecies/multigears Mediterranean fisheries.
