2 ABOUT THE NORTH DAKOTA TRIBAL CHILD WELFARE SERVICES DIRECTORY: This directory is a compilation of various directories found on-line either through the ND Indian Affairs Commission, ND Tribal website directories, or miscellaneous sources. While there are many more tribal programs on each reservation, this directory lists only those tribal or community programs that are specific to issues or services that may be of interest to off-reservation social workers or Non-native foster parents, who are seeking to access information, services or resources for native children and families they are working with and who reside offreservation. Many tribal program geographic service areas are for tribally-enrolled members who live on or near the reservations they are enrolled at. However, some services and resources are available to any enrolled member whether they reside on or off-reservation. It is recommended to contact that program individually to find out about eligibility criteria and geographic service areas. FREQUENTLY ASKED QUESTIONS: How does someone get enrolled in a tribe? The person who is interested in applying should contact the local tribal or Bureau of Indian Affairs enrollment office to request an application. Each tribe has their own specific enrollment criteria which is different from tribe to tribe. The application usually requires you to list the name(s) of the parent or grandparent(s) who were enrolled member of that tribe. Each tribal council has specific times of years when they review enrollment applications, which could be on a quarterly, annual or as specified basis. Do Indian people get free health care? An enrolled member of a federally recognized tribe is eligible to receive services with no out of pocket costs by them at any Public Health Service, Indian Health Service clinic or hospital. These I.H.S. or tribal medical facilities are generally located in reservation based communities, although there are some large I.H.S. hospitals or urban Indian clinics that are located in large urban areas with high American Indian populations, e.g. Seattle, Portland, Santa Fe, Minneapolis. However, in ND each tribe has an either an I.H.S. or tribal clinic or hospital facility located on their respective reservation. Enrolled tribal members who reside off reservation may also receive services from these facilities if the services are provided services on site. Dependent on the tribal or I.H.S. facility, services generally include, optometry, dental and behavioral health. These medical/health services are part of the trust responsibility of the federal government that were conditions of the treaties that many tribes signed that were given in return for the land that many tribes gave up. Who is eligible for contract health care? Contract health care is a term used by I.H.S. or tribal facilities to describe funds that each tribal or I.H.S. facilities has to pay for medical care from outside facilities and not provided on-site through their facility. Generally, contract health care funds are used to pay for services provided to onreservation, enrolled tribal members only. These funds are limited and many times a priority system is used, with highest priority given to life threatening situations, then limb, then other serious medical condition, to those that are less serious in nature. It is highly recommended to contact the Contract Health Care directly on each reservation to find out what is available. As a general rule, oftentimes referred to as the 180 day rule, if an enrolled tribal members leaves the reservation for more than a 180 days (6 months) for reasons, other than military service, educational pursuits or lengthy hospitalization, the enrolled member is no longer eligible for contract health care unless they move back to the reservation. Sometimes tribes who have contracted from I.H.S. 2 P a g e

3 to administer their own health care facility, may decide to modify guidelines. Each contract health care office should be contacted as soon as possible before seeking medical care or within a 72 hour period after an emergency situation to find out if the enrolled member is eligible for contract health care. Why do some tribes have Bureau of Indian Affairs (B.I.A.) or Indian Health Service (I.H.S.) programs versus tribal programs which other tribes have? e.g. B.I.A. or tribal Social Services; B.I.A. or tribal enrollment or I.H.S. or tribal clinic Since the initial passage of the P.L Indian Self-Determination & Education Assistance in 1978 and subsequent reauthorizations, each tribe has the authority to contract and administer tribal trust services that were formerly administered by the B.I.A. or I.H.S. These contracts are generally referred to as 638 contracts. In the case of social services, sometimes the tribe may have only contracted part of the social service functions such as child welfare/child protections services but have left the remainder of the social service programs with the B.I.A. In other cases, the tribe has fully contracted social services. Some tribes are now considering 638 contracting their I.H.S. medical facilities or portions of the services they provide. What types of court cases are heard in tribal courts? Usually they are civil/domestic cases and minor criminal cases. Criminal cases that are felony crimes are investigated by the Federal Bureau of Investigations (F.B.I.) and are under the jurisdiction of the federal court system. Some tribes do not have a tribal court system, but all of the ND tribes have a tribal court system and juvenile justice systems. When does the Indian Child Welfare Act (ICWA) Law apply? Generally, whenever there is an Indian child who is taken into state care because of child neglect or abuse, the state or county must notify the tribe that the child is enrolled in or eligible to be enrolled in. The child s tribe will then decided whether they will intervene and take custody or to allow the state to continue custody and care of the child. It is strongly recommended that social workers contact the tribes of the parent(s) to notify them when there is a potential ICWA case. Each ND tribe has an ICWA office, which may be part of the tribal social services or child welfare/protection agency. Do Indians get free monthly checks from the government? No, there are no government checks issued to American Indians based on their membership status. Most Indians who do receive a government check may either receive checks that are related to entitlement programs e.g. income related to poverty or low income such as public assistance that is available to any U.S. citizen who meets income guidelines; or they may receive government lease payments from their trust lands or minerals that are leased by a third party. The way the trust responsibility and relationship is set up, the third party makes the lease payment to the B.I.A. for the person s who trust land is being leased, the B.I.A. then deposits the funds into the tribal members Individual Indian Monies (IIM) Account and then another U.S. Treasury check is re-issued to pay the money to them. Do all Indians own trust land? Not all Indians own trust land. Those who do, have inherited the trust lands from their parents, grandparents or other relatives. Sometimes, trust lands have been sold by the owners so that after they pass on, there are no trust lands that are inherited by their living family members. Additionally, some tribal members have written wills that have specified who are their heirs to their trust land will be while those that have not left a will, the tribal probate laws will be applied. It is recommended that a person inquiring about any trust lands, contact the B.I.A. or tribal realty or probate office. 3 P a g e
