2 1. Welcome / Apologies / Noting of Alternates. As shown on page 1. No one attended on behalf of Nigel Oatway nor Chris Johnson 2. Minutes of last meeting (14 th July 2015) a) Accuracy The minutes of the last meeting will be signed by the Deputy Chairman on his return to the Board; in recognition that they provided an accurate account of the meeting. b) Matters Arising Attribution of delays caused by stopping for domestic animals guidance note. Lee Robinson was concerned that the application of the Animal Welfare Act had not been taken in to consideration when providing this guidance. She had asked for confirmation from the RSPCA as to whether this Act applied to the Railway. A response to this is pending. The Board discussed the matter and concluded that the guidance was given based on the information that was available at the time. ATW could potentially use this further information in the event that they decided to challenge the guidance. It was noted that although the Rule Book implies that Drivers may continue their journey even if there is a dog or other domestic animal on the line, many Drivers may choose to stop as past experience has seen trains being delayed for long periods of time due to shoes being knocked off for example, as happened at Sydenham recently. The application of Signallers General Instructions was also raised as this is more prescriptive regarding when to caution for animals. Carew Satchwell and the Chairman both confirmed that these instructions are endorsed by Industry and as such they carry the same weight as the Rule Book. It was suggested that in future, guidance requests that where the Rule Book is quoted that parties set out their interpretation and the RSSB are actually asked in advance (either by the parties of by the ) to confirm the correctness of the interpretation. The template for Requests for Guidance will be amended to highlight this requirement. The Board agreed that the guidance note was therefore appropriate (with the alterations proposed by members prior to the meeting) and ought to be provided to the parties as the guidance provided could be challenged. Action 129/15-01: The to amend the Request for Guidance template to highlight the need to explain their understanding of Rule Book quotes. 3 animals. Guidance regarding the attribution of delays caused by the late signing on due to a delayed lodging turn. Some alterations were received by Board members and were agreed during the meeting. It was also noted that VTEC had accepted the incidents prior to receiving the formal guidance note. The DAB Secretary is re-writing the previous next day crew provision proposal for change to reflect this guidance and will submit the revised proposal to the September DAB meeting. Action 129/15-03: The to provide VTEC and Network Rail with the guidance note for the attribution of delays caused by booking on late after a delayed lodging turn. Action 129/15-04: The Secretary to submit a proposal for change to the DAG to reflect the attribution of delays caused by booking on later after a delayed lodging turn. c) Actions The actions were reviewed and updated as shown in Appendix A. 3. DAB Business review recommendations The Board discussed the recommendations and confirmed which recommendations were now complete. This would be recorded within the project plan. NTF-OG had had a similar update and was pleased with the progress in all areas. Both NTF-OG and the DAB were concerned with the level of training provision provided. NTF-OG has nominated Iain Flynn from Network Rail to be their sponsor and will work closely with Alex Kenney and the Secretary to drive the resolution of this matter. A question is to be posed to NTF-OG as to how they see the DAB s remit should the DAB lead and direct how attribution should look in CP6 or should DAB be a provider of a service to Industry i.e. help guide the discussions but ultimately deliver what is required of the attribution process. DAB felt it was the latter but the question will be posed to NTF-OG to gauge their opinion. A review of training will be part of the October DAB meeting The Chairman raised the implications of improved focus on Right Time Railway and how data recording potentially becomes more detailed. It was suggested DAB consider having a presentation with a RTR representative either from DfT or Network Rail to ensure PDAC is still appropriate. Alex Kenney reminded DAB members that PDAC was as much a part of DAB as the DAG and has been a poor relation so a review of PDAC is long overdue. DAB-129 4th August 2015 Minutes FINAL Page 3
4 The Secretary highlighted that an action to carry out an audit each year but felt that it was not DAB s place to do an official audit. It was suggested that the DAB business review recommendation be combined with the informal investigations emanating from KPI data reviews (as was carried out on the Southeast Route) and also in line with Surgeries. 4. Joint responsibility A paper was provided in advance of the meeting. The Board supported the consideration to provide improved references within the DAG to refer to section of the DAG to make sure that joint responsibility criteria was considered appropriately in all cases. The Board supported the recommendation to define physical works as well as train borne to ensure the relevant circumstances that do not constitute joint responsibility are set out in more detail. As previous work streams it was suggested that examples are provided of common scenarios to give the DAG users a steer on application (Including termini, incidents involving coping stones, terminating short etc.). Additionally as stated within the paper was to review and clarify the station closure section so that joint responsibility criteria can only be applied in the appropriate circumstances (i.e. not closed by default or by a non-responsible person). Critically the recording of the time of station closure and opening is often overlooked and in essence the DAG cannot apply if these facts are not known. This element of recording is required to allow for the correct sections of the DAG and in future, the E- DAG to be applied. It was also suggested that the DAB remind users that many aspects of compensation emanating from incidents at stations should be progressed through the Station Access Contract and not through Schedule 8 which is part of the Track Access Contract. The initial version of the e-dag was demonstrated covering examples of joint responsibility incidents. It was well received and supported for further development in line with proposals developed through the joint responsibility work stream. 5 5. Regulation A paper providing a problem statement regarding the attribution of delay caused by the reaction to regulating trains was submitted to the Board prior to the meeting.. The Board agreed that specific guidance on correct or wrong regulation was not possible due to the many factors involved and that every regulation situation was, by nature, different. However, it should be possible to set out considerations that attribution and resolution staff should consider before determining whether regulation was correct or not. The Board members were asked to let the Secretary know of any consideration they believe should be factored and asked that the Secretary collate these and provide the DAB with a proposal for consideration in relation to attribution of delays caused by the regulating of trains. Initial thoughts were to include a review of similar scenarios, sphere of operation, taking post regulation events into consideration (would the Signaller had known at the time), regulation policies (specific and generic). Action 129/15-06 The Secretary to provide the Board with suggested elements for consideration in relation to attribution of delays caused by the regulating of trains. Request that a Network Rail Local Operations Manager come and present to the DAB in October the logical reasoning behind the regulating of trains and consideration made in decision making. 6. Reactionary Delay A paper providing another example of reactionary delay which would from part of the process note suite was submitted to the Board prior to the meeting. The Board reviewed the content and agreed that of the two suggested attribution methods, attribution 2 would be the correct application.
