1 11 Legal Studies TASK 1: The Australian Legal System Due Date: Friday 24 th March 2017 Date Distributed: Wednesday 1 st March 2017 Task Weighting: 20% Outcomes P1. identifies and applies legal concepts and terminology P2. describes the key features of Australian and international law P3. describes the operation of domestic and international legal systems P6. explains the nature of the interrelationship between the legal system and society P7. evaluates the effectiveness of the law in achieving justice P9. communicates legal information using well-structured responses ASSESSMENT OUTLINE 1. WHAT AREAS OF LEARNING DOES THIS ASSESSMENT ADDRESS? In this task, students will be required to: research and annotate a media file, including articles that illustrate the operation of the Australian legal system demonstrate knowledge and understanding of sources of contemporary Australian law and its application communicate using relevant legal terminology and concepts refer to relevant examples present a sustained, logical and cohesive response in essay format 2. WHY IS THE COMPLETION OF THIS ASSESSMENT IMPORTANT? This task is an opportunity for students to demonstrate their understanding of the operation of the Australian legal system and how the law tries to achieve justice for citizens within its jurisdiction. Students are required to access the media and attain real world examples in order to reflect and apply their understanding of the syllabus. 3. WHAT STEPS DO I TAKE TO COMPLETE THIS TASK? Task Outline Part 1: Media File Research, annotate and submit a media file which contains: I. Three (3) recent* media articles which illustrate the operation of the Australian legal system. ** II. Analysis and annotation for each article demonstrating sound knowledge of the role of the legal system.
2 III. A copy of each article or a weblink to the article with a clearly labelled source, including the date. IV. Use of legal terminology and concepts throughout the analysis. *The media articles or source must be recent and cannot be dated more than 5 years ago. Each report for each article should be a minimum of 300 words **Operation of the Australian Legal System Choose topics from the following list to form the basis of your research and media file: NSW Parliament s ability to repeal a NSW legislation Court s ability to uphold decision regarding procedural fairness Parliament s ability to amend a statute law Courts ability to create common law (precedent) High Courts ability to interpret the Australian Constitution Federal Court s ability to make a ruling in a family law matter The jurisdiction of the Coroner s Court to investigate suspicious deaths Application of customary law in the NSW legal system The ability of statute law to override common law in NSW Children Court s ability to make a ruling in a juvenile case Part 2: Extended Response (In-Class Essay) In class, you will be expected to write a response to a stimulus that reflects you understanding of the following statement: Examine the sources of contemporary Australian law and explain how the law tries to achieve justice for those within its jurisdiction. A checklist appears below to help you prepare for this assessment: Students should begin their preparation by reading over their class notes and relevant sections of the textbook. Students should also investigate relevant websites e.g. those referred to in the textbook and the State Library Research Guides for Legal Studies. Students need to understand that examine means to inquire into and explain means to relate cause and effect; make the relationships between things evident, provide why and/or how. Essay format must be used i.e. there needs to be an introduction, main body and conclusion. Paragraphs should be used (no headings or bullet points). The essay must be in the third person e.g. do not say I think, My opinion is, instead write things like The evidence suggests or It appears clear that Students need to use a range of legal terminology, concepts and examples where appropriate Students need to write approximately 900 words.
3 Details for Submission Part A Media File Students are to submit their media file at the start of the lesson, on Friday 24 th March, before they commence the in-class essay. This is a hand-in task. Failure to hand in work on the specified date, with no successful illness/misadventure appeal, will receive a zero-mark and an N-Warning notification. Students will still need to submit the media file to ensure learning outcomes are met. Since this is a hand-in task, students should be aware of the details concerning malpractice and misconduct, as outlined in the Year 11 Assessment Booklet. It is expected that students will submit their own work and fulfil the obligations of the All My Own Work policy. Part B Extended Response (In-Class) Once students have submitted their media file, they will have 45 minutes to complete the extended response in exam conditions. Students must bring the required equipment for the in-class essay, which is a blue or black pen. Writing paper and a copy of the question will be provided on the day. Students are NOT permitted to bring notes for this task. The essay must be handed to the teacher before leaving the room. School policy regarding absence and extensions will apply. 4. HOW WILL MARKS BE AWARDED TO MEASURE MY LEARNING? See the marking criteria for both Part A and Part B on the following pages.
4 PART A: MEDIA FILE Marking Criteria (for each article) Selects and submits an appropriate article which illustrate the operation of the legal system Analyse all the articles/cases and relate the articles/cases to theory Demonstrates outstanding knowledge of the role of the legal system Answers all aspects of the question in a well-structured manner Uses legal terminology and concepts throughout the paper Submits an appropriate article which illustrate the operation of the legal system Analyse some of the articles/cases and relate some of the articles/cases to theory Demonstrates sound knowledge of the role of the legal system Answers most aspects of the question in a well-structured manner Uses legal terminology and concepts Submits a relevant media articles Can describe the articles/cases or relate the articles/cases to theory Demonstrates some knowledge of the role of the legal system Answers some aspects of the question in a well-structured manner Uses some legal terminology and concepts Selects a relevant article Makes a valid statement or statements about articles/cases and makes an attempt to relate a case to theory Makes a valid statement of the role the legal system Answers part of the question with general statements Uses little or no legal terminology and concepts Student selects an article Student answers some aspects of the question Makes general statements about the law and cases Uses no legal terminology Marks
