2 What Is the WIPO Development Agenda? The Development Agenda in WIPO is a Member Statesdriven process, which seeks to place the development dimension at the core of the global IP system. It seeks to do so inter alia through: Making the global IP system more development friendly by taking into consideration the specific needs and challenges faced by developing countries and LDCs. Ensuring a balance between the rights of IP holders and public interests in addressing such issues as access to medicines, access to knowledge, transfer of technology, and achieving the UN MDGs etc. Ensuring that development considerations become integral to WIPO s work.

3 Development Agenda Recommendations the Clusters The 45 recommendations are grouped into 6 clusters: Technical Assistance and Capacity Building (14 recommendations). Norm-setting, Flexibilities, Public Policy and Public Domain (9 recommendations). Technology Transfer, Information and Communication Technologies and Access to Knowledge (9 recommendations). Assessment, Evaluation and Impact Studies (6 recommendations). Institutional Matters (6 recommendations) Other Issues (1 recommendation).

4 Key Themes of the Development Agenda Recommendations To explore or initiate further work in various areas of the IP systems some examples: Transfer of Technology. IP and the Public Domain. IP and Competition policy. IP, ICT and the Digital Divide. The use of flexibilities in the Multilateral Legal Framework.

To enhance WIPO s way of working: Results-Based Management (RBM) Framework Ethical conduct of WIPO Staff and Consultants Technical Assistance based upon the principles of; Demand-driven. Taking into consideration different levels of development. Cost and benefits of the use of IP. Mobilizing Resources for Development. Matchmaking database for bilateral and multilateral assistance.

6 Key Themes of the Development Agenda Recommendations (cont.) To provide assistance to Member States: Facilitate development of National IP strategies. Establishment of Technology and Innovation Support Centers (TISCs). Establishment of Mini IP Academy. Support to SMEs. Tools for Access to Patent Information. Use of Branding for Business Development.

7 Development Agenda Implementation Mainstreaming of Development Agenda principles in the work of WIPO. Organization-wide implementation through integration in Program and Budget. Project-based methodology for implementation (20 projects so far approved now at different stages of implementation). Designated Project Managers taking charge of formulation of project proposals and implementation based on the DA recommendations. Provision of funds for DA implementation - Approximately 20 million Sfr committed so far to various projects.

8 The Committee on Development and IP (CDIP) The CDIP is a Member States-driven Committee established in 2007 with the following mandate: Develop a work-program for implementation of the 45 adopted recommendations; Monitor, assess, discuss and report on the implementation of all recommendations adopted, and for that purpose it shall coordinate with relevant WIPO bodies; and Discuss IP and development related issues as agreed by the Committee, as well as those decided by the General Assembly. The CDIP reports and makes recommendations annually to the WIPO General Assembly.

9 Work of the CDIP Six sessions of the CDIP have been held since projects have been approved so far for implementation. Almost all the substantive recommendations have been discussed. 11 Examples of Projects Considered by the CDIP Intellectual Property and Socio-Economic Development. Intellectual Property and Product Branding for Business Development in Developing Countries and Least-Developed Countries (LDCs). Capacity-Building in the Use of Appropriate Technology. Specific Technical and Scientific Information as a Solution for Identified Development Challenges. IP and Technology Transfer. Intellectual Property and the Public Domain. Intellectual Property and Competition Policy. Intellectual Property, Information and Communication Technologies, the Digital Divide and Access to Knowledge. Developing Tools for Access to Patent Information. Enhancement of WIPO's Results-Based Management (RBM) Framework to Support the Monitoring and Evaluation of Development Activities.

12 Some Important Considerations for Implementation It is a collective effort (Secretariat + Member States + other stakeholders). Must reflect the ground reality and respond to the real needs and interests of Member States. Should address the concerns behind the recommendations. Ensure mainstreaming of the DA principles into all of WIPO s work. Should be member-driven and inclusive. Equitable geographical distribution of projects. Projects should be sustainable. Important that local partners are fully committed to the projects.

13 Development Agenda Implementation In WIPO Member Countries Some Considerations Develop national IP and Innovation strategies. Focus on development objectives, national priorities, level of development, and public interests. Review WIPO s on-going work and identify projects and activities of your national interest. Propose activities in the framework of the 45 recommendations that may help your country and other developing countries.
